RECOMMENDATION(S)
Recommendation
1. Approve Amendment No. 2 to non-financial Memorandum of Understanding No. 19-843, with San Mateo County Behavioral Health and Recovery Services Division to continue to provide non-exclusive license rights to the materials, media, and other assets related to the Cannabis Decoded Campaign by exercising the final one-year extension for the total period of December 17, 2019 to December 16, 2024.
2. Authorize the Director of the Department of Behavioral Health, as the County Mental Health Director, to execute and submit Amendment No. 2 to Memorandum of Understanding No. 19-843 with San Mateo County Behavioral Health and Recovery Services Division, on behalf of the County, subject to County Counsel review.
3. Direct the Director of the Department of Behavioral Health, as the County Mental Health Director, to transmit Amendment No. 2 to Memorandum of Understanding No. 19-843 with San Mateo County Behavioral Health and Recovery Services Division to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
This item does not impact Discretionary General Funding (Net County Cost). The Memorandum of Understanding (MOU) is non-financial in nature.
BACKGROUND INFORMATION
The Department of Behavioral Health (DBH) is responsible for providing mental health and substance use disorder services to County residents who are experiencing severe mental illness and/or substance use disorders. The Cannabis Decoded Campaign (Campaign) developed by San Mateo County Behavioral Health and Recovery Services Division (San Mateo County) is a Youth Marijuana Education Initiative. The initiative was launched in partnership with the San Mateo County Youth Commission to educate youth, young adults, and their parents and/or caretakers about cannabis use.
DBH has worked with San Mateo County to develop the Campaign using the materials, media, and other assets provided through the MOU. The Campaign is research-based and developed to assist in educating youth, young adults, and their parents and/or caretakers on the facts of cannabis use, to allow them to fully understand the health effects of cannabis use. The Campaign includes information for breastfeeding and expectant mothers, handouts for tweens, teens, and young adults, as well as a guide for parents and/or caretakers on having developmentally appropriate conversations about cannabis use. The recommended amendment to the MOU with San Mateo County will extend the license rights to the materials, media, and other assets related to the Campaign for another year enabling County youth and young adults to continue to make informed decisions regarding cannabis use.
On December 17, 2019 (Item No. 16), the Board of Supervisors (Board) approved MOU No. 19-843 with San Mateo County to establish the terms under which non-exclusive license rights to the materials, media, and other assets related to the Campaign will be provided, for the period effective December 17, 2019 through December 16, 2022. In addition, this item authorized the Director of DBH to execute and submit the MOU, including any subsequent non-substantive revisions and amendments, on behalf of the County and subject to review by County Counsel, as required by San Mateo County.
On November 15, 2022 (Item No. 22), the Board approved Amendment No. 1 to MOU No. 19-843 with San Mateo County to provide terms under which non-exclusive license rights to the materials, media, and other assets related to the Campaign will be provided, for the period effective December 17, 2019 through December 16, 2023. In addition, this item authorized the Director of DBH to execute and submit Amendment No. 1, including any subsequent non-substantive revisions and amendments, on behalf of the County and subject to review by County Counsel, as required by San Mateo County.
Amendment No. 2 to the MOU exercises the final extension, and requests authorization for the DBH Director, as the County Mental Health Director, to execute and submit the amendment, on behalf of the County, subject to review by County Counsel, as required by San Mateo County. DBH will transmit any subsequent non-substantive amendments to the Clerk of the Board of Supervisors within 30 days of execution.
The MOU may be terminated by either party without cause upon 30 days’ written notice. DBH will monitor the MOU on a regular basis to ensure standards are met.
