RECOMMENDATION(S)
Recommendation
1. Adopt the Initial Study and Mitigated Negative Declaration for the Lake Gregory Regional Park Sitewide Sediment Management Project.
2. Adopt the Mitigation Monitoring and Reporting Plan for the Lake Gregory Regional Park Sitewide Sediment Management Project.
3. Approve the Lake Gregory Regional Park Sitewide Sediment Management Project as defined in the Initial Study and Mitigated Negative Declaration.
4. Approve plans and specifications for the Lake Gregory Regional Park Sitewide Sediment Management Project.
5. Approve Amendment No. 1 to Contract No. 23-477 with Michael Baker International for professional engineering design services associated with the Lake Gregory Regional Park Sitewide Sediment Management Project, increasing the total approved contract amount by $23,936, from $463,204 to $487,140, with no change to the contract term of May 23, 2023, through December 31, 2026.
6. Authorize the Director of Public Works - Special Districts to advertise the Lake Gregory Regional Park Sitewide Sediment Management Project for competitive bids.
7. Direct the Department of Public Works - Special Districts to file and post the Notice of Determination for the Lake Gregory Regional Park Sitewide Sediment Management Project as required under the California Environmental Quality Act.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). Reimbursement of eligible expenditures for the Lake Gregory Regional Park Sitewide Sediment Project (Project) will be funded through an allocation from the County’s American Rescue Plan Act (ARPA) Coronavirus Local Fiscal Recovery Fund (CLFRF) for eligible costs as approved by the Board of Supervisors (Board) on October 25, 2022 (Item No. 82). These costs include the amended contract with Michael Baker International (MBI) in the amount of $487,140 and the Project’s future construction.
Sufficient appropriation for the Project is included in the Department of Public Works - Special Districts’ (Department) ARPA Capital Improvement Projects (CIP) 2024-25 budget and will be included in future recommended budgets as needed.
BACKGROUND INFORMATION
The Department provides design, construction, operations and maintenance support services to Regional Parks, which includes Lake Gregory. The Project consists of the removal of accumulated sediment at Lake Gregory. Additional sediment and debris were deposited in the lake during the 2020, 2021, and 2022 storm seasons. Removal of accumulated sediments will improve the health of the lake as well as the recreational use of this amenity. The Project is a priority to effectively manage lake sediments and long-term maintenance of Lake Gregory.
In accordance with the California Environmental Quality Act (CEQA) and CEQA Guidelines, an Initial Study (IS) was prepared to identify potential impacts that the Project may have on the environment. The IS concluded that all potentially significant environmental impacts resulting from the Project’s construction can be mitigated to a less-than-significant level. Therefore, a Mitigated Negative Declaration (MND) for the Project is warranted.
The MND was circulated on May 27, 2024, to the responsible and trustee agencies, interested organizations and individuals, and the State Clearinghouse for the 30-day comment period as specified in the CEQA Guidelines. Comments were received and responded to via a Response to Comments (RTC) document, which is an attachment to the IS/MND document.
As all the potential environmental impacts can be adequately mitigated during Project construction, the Department recommends the following:
• Adoption of the IS/MND.
• Adoption of the Mitigation Monitoring and Reporting Plan in compliance with Section 15074 of the CEQA Guidelines.
• Approval of the Project as defined in the IS/MND.
• Filing of the Notice of Determination.
This item also seeks approval of Amendment No. 1 (Amendment) to Contract No. 23-477 with MBI, approved by the Board on May 23, 2023 (Item No. 67), to add an additional $23,936 to the total approved contract amount of $463,204, for an amended total of $487,140. The Amendment will compensate the consultant for additional engineering design review support, Administrative Draft California Environmental Quality Act documentation, and pre-application jurisdictional wetland/waters permit support required for the Project beyond the level of support identified in the original scope of work.
In addition, this item seeks Board approval of the Project’s plans and specifications and authorizes the Department Director to advertise the Project for competitive bids.
PROCUREMENT
Upon Board approval of this item, the Project will be advertised in accordance with Section 22037 of the California Public Contract Code. The Department anticipates returning to the Board in November 2024 with a recommendation for award of the Project’s construction contract.
