RECOMMENDATION(S)

Recommendation

Adopt the Designation of Applicant’s Agent Resolution for Non-State Agencies from the California Governor’s Office of Emergency Services, authorizing the Chief Executive Officer, the Director of Emergency Management, or the Assistant Director of Emergency Management to execute reimbursement claims on behalf of San Bernardino County for the purpose of obtaining federal and/or state financial assistance as compensation for costs resulting from all open and future disasters, for up to three years following the date of execution.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Resolution will authorize the Office of Emergency Services (OES) to receive federal and state funds for reimbursement of costs associated with disaster events. The action to adopt the proposed Resolution is administrative in nature and has minimal financial impact.

 

BACKGROUND INFORMATION

The California Governor’s Office of Emergency Services (Cal OES) requires a Designation of Applicant’s Agent Resolution for Non-State Agencies (on template Cal OES Form 130), which designates authorized representatives to administer applications, claims, reimbursements, advancements, and related documents for the purpose of obtaining certain federal and/or state financial assistance, including grant funded programs, such as the Hazard Mitigation Grant Program (HMGP), offered under disaster declarations under Public Law 93-288, as amended by the Robert T. Stafford Disaster Relief and Emergency Assistance Act of 1988 (Public Law 93-288), and/or state financial assistance under the California Disaster Assistance Act.

 

OES applied for and received HMGP funding under Disaster Declaration No. FEMA-4699-CA, which was approved by the Board of Supervisors (Board) on March 25, 2025 (Item No. 26) and included the adoption of Resolution No. 2025-69, designating certain County agents to execute and file documents for the HMGP (State Award No. FEMA-4699-DR-CA). In addition to Resolution No. 2025-69, Cal OES requires the adoption of a Resolution on their template (Cal OES Form 130) in order to authorize the Chief Executive Officer, the Director of Emergency Management, or the Assistant Director of Emergency Management to file documents with Cal OES for the HMGP and for the purpose of obtaining federal financial assistance under Public Law 93-288 and/or state financial assistance under the California Disaster Assistance Act.

 

The required Cal OES Form 130 Resolution streamlines processes by allowing OES to submit necessary documents, request reimbursements and advancements, submit performance reports, and sign other related documents for the HMGP and other disaster-related federal and/or state financial assistance for a period of three years.

 

Adoption of the Cal OES Form 130 Resolution will authorize OES’s designated agents to obtain federal and/or state financial assistance through filing disaster applications, providing proper documentation, filing reimbursement claims on declared disasters, and signing any necessary documentation required to secure cost reimbursements. OES will return to the Board for approval to apply for and receive future federal and/or state financial assistance.
