Recommendation
1. Acting as the governing body of San Bernardino County, approve Memorandum of Understanding between San Bernardino County, through the Sheriff/Coroner/Public Administrator, and County Service Area 70 for County Service Area 70 to provide operation, maintenance and management services for the County-owned water distribution and water treatment systems, located at the High Desert Detention Center, for an aggregate amount not-to-exceed $2,878,406, for the term of July 1, 2023 through June 30, 2028, with an option to extend the term for three additional one-year periods.
2. Acting as the governing body of County Service Area 70 (Countywide), approve Memorandum of Understanding between San Bernardino County, through the Sheriff/Coroner/Public Administrator, and County Service Area 70 for County Service Area 70 to provide operation, maintenance and management services for the County-owned water distribution and water treatment systems, located at the High Desert Detention Center, for an aggregate amount not-to-exceed $2,878,406,, beginning July 1, 2023 through June 30, 2028, with an option to extend the term for three additional one-year periods.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). In accordance with the recommended Memorandum of Understanding (MOU), the Sheriff/Coroner/Public Administrator (Sheriff) shall reimburse County Service Area 70 (CSA 70) a total not-to-exceed amount of $2,878,406 for the costs of operating and maintaining the water distribution and treatment systems at the High Desert Detention Center (HDDC). This amount would be over the term of the MOU from July 1, 2023, through June 30, 2028, and funded through the Sheriff’s existing Net County Cost allocation.
Appropriation for the costs of this MOU has been included in the 2023-24 Recommended Budget for both the Sheriff and CSA 70 and will be included in future recommended budgets.
BACKGROUND INFORMATION
In January 2006, HDDC was added as the fourth detention facility in the County’s Bureau of Corrections and became the first facility of its size to serve the High Desert region. As part of construction of the facility, a water well, reverse osmosis water treatment unit, large reservoir and associated appurtenances were designed and constructed on-site. The Sheriff is responsible for ensuring that the water distribution and water treatment system operation, maintenance and management services are conducted at the HDDC according to federal, state and local regulatory requirements. The Sheriff satisfies this obligation through an MOU with CSA 70.
CSA 70 has been providing the subject services for the Sheriff since January 28, 2014. The current MOU between the Sheriff and CSA 70, which was approved by the Board of Supervisors (Board) on June 16, 2015 (Item No. 90), expires on June 30, 2023. Board approval of a new MOU is recommended so that CSA 70 can continue to perform system operation, maintenance, and management services for HDDC. CSA 70 staff have the required certifications and experience necessary to ensure public health and safety by meeting all regulatory requirements associated with these services.
An MOU with CSA 70 for the operation, maintenance, and management of the County-owned water distribution and water treatment systems located at HDDC ensures the goal of maintaining public health by providing water that meets federal, state and local water quality parameters.
