RECOMMENDATION(S)

Recommendation

1.                     Approve Addendum No. 1 to the bid documents, issued on March 8, 2022, for the construction of the Mid-Valley Sanitary Landfill West Channel Improvements.

2.                     Approve Addendum No. 2 to the bid documents, issued on March 14, 2022, for the construction of the Mid-Valley Sanitary Landfill West Channel Improvements.

3.                     Award a construction contract to Jeremy Harris Construction, Inc. (Riverside, CA) in the amount of $1,597,620 for the construction of the Mid-Valley Sanitary Landfill West Channel Improvements.

4.                     Authorize a contingency fund of $159,762 for the Mid-Valley Sanitary Landfill West Channel Improvements.

5.                     Authorize the Director of the Department of Public Works to approve the expenditure of a contingency fund of $159,762 for verified quantity overruns for this unit priced construction contract.

6.                     Authorize the Director of the Department of Public Works to order any necessary changes or additions in the work being performed under the contract for a total amount not to exceed $92,381, of the contingency fund listed above, pursuant to Public Contract Code section 20142.

7.                     Authorize the Director of the Department of Public Works to accept the work when 100% complete and execute and file the Notice of Completion.

Provide for the Safety, Health and Social Service Needs of County Residents.

 

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as the Department of Public Works - Solid Waste Management Division (SWMD) is financed by fee revenue. SWMD establishes fees that are charged to the public and other agencies for utilization of the County’s Waste Disposal System. The construction contract of $1,597,620 and any use of the proposed contingency fund for the Mid-Valley Sanitary Landfill West Channel Improvements (Project) will be funded by SWMD fee revenue.  Sufficient appropriation and revenue have been included in the SWMD 2022-23 Recommended Budget and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

The County's Mid-Valley Sanitary Landfill (MVSL) is located in the City of Rialto, northwest of the intersection of Alder Avenue and State Route 210. The site occupies approximately 448 acres of which 408 are permitted for refuse disposal. The site is divided into five separate waste management units. The Project will enable SWMD to properly manage stormflows through the site, reduce pollutant runoff, prevent erosion and site damage, and protect an adjacent landfill cell.  The Project consists of constructing a 1,300 feet long and 24 feet wide concrete channel between Unit 1 and Unit 4.

 

The Project meets the County and the Chief Executive Officer’s goals of providing for the safety, health and social service needs of County residents by operating the landfill in a responsible manner and protecting the recently constructed cell allowing for continued refuse disposal services.

 

Following Board of Supervisors (Board) approval of this item, construction is anticipated to commence in June 2022 and be completed in December 2022.

 

PROCUREMENT

On February 8, 2022 (Item No. 41), the Board approved the Project’s plans and specifications, as well as authorized the Director of the Department of Public Works to advertise the Project for bids.  This Project was released on the County Electronic Procurement Network (ePro) on February 17, 2022 and advertised in the Daily Press and Precinct Reporter newspapers on February 17 and 24, 2022.  A notice inviting bids was also provided to specified construction trade journals as required by Public Contract Code section 22036. A mandatory pre-bid meeting and job walk was held on Tuesday, March 1, 2022, and was attended by 14 firms.  

 

There were two addendums issued during the bidding phase, revising the Project plans and specifications as follows:

 

                     Addendum No. 1 - providing a copy of pre-bid sign in sheets and providing responses to questions submitted.

 

                     Addendum No. 2 - amending Special Provisions by replacing the bid schedule and providing responses to questions submitted.

SWMD has reviewed the bids received and determined that they are responsive and recommends that the Board award the contract to Jeremy Harris Construction, Inc., the lowest responsible bidder. No appeal/protest letters were received.

 

The Project will have a total contingency fund of $159,762 to compensate the contractor for verified quantity overruns for this unit priced construction contract, as well as changes in the contract under certain circumstances.  Under an established formula based on the contract amount, Public Contract Code section 20142 allows the Board to authorize the Director of Public Works to order changes in the contract, including for unforeseen conditions or design shortfalls, should they become necessary in the future for a total amount not to exceed $92,381 of the $159,762 contingency fund.
