Recommendation
Acting as the governing body of the San Bernardino County Fire Protection District:
1. Approve the no-cost Agreement for the Temporary Transfer of Equipment with San Bernardino Regional Emergency Training Center Joint Powers Authority for the temporary provision of Self-Contained Breathing Apparatus and related equipment for use during training courses held at the San Bernardino Regional Emergency Training Center Facility for the period from March 15, 2022 to March 14, 2027.
2. Find the no-cost Agreement for the Temporary Transfer of Equipment with the San Bernardino Regional Emergency Training Center Joint Powers Authority is authorized by Section 5 of Joint Exercise of Powers Agreement No. 98-421 and serves the following San Bernardino County Fire Protection District purposes:
a. Allows San Bernardino County Fire Protection District staff to attend training required for initial and mandatory recurrent training to qualify as firefighters at airports classified by the Federal Aviation Administration; and
b. Benefits the San Bernardino County Fire Protection District by providing staff access to equipment during training that is the same or similar to that which is used during the course of their normal duties.

FINANCIAL IMPACT
Approval of this agreement will not result in the use of additional Discretionary General Funding (Net County Cost). Temporary use of the Self-Contained Breathing Apparatus and related equipment, as provided by the San Bernardino County Fire Protection District (SBCFPD), will be at no cost to the San Bernardino Regional Emergency Training Center Joint Powers Authority (JPA). However, the JPA will be responsible for reimbursing SBCFPD for any cost of repairs or replacement costs from loss or damage incurred while the equipment is under the JPA’s possession.
BACKGROUND INFORMATION
SBCFPD is a community-based, all hazard emergency services organization providing various services including emergency mitigation and management for fire suppression. SBCFPD is dedicated to the protection of the public it serves. SBCFPD offers services beyond fire suppression and protection and partners with various private and public collaborators to protect their communities and improve disaster preparedness, response, and communications.
SBCFPD and the JPA work together to provide Aircraft Rescue and Fire Fighting (ARFF) training to public and private fire service agencies from around the world at the San Bernardino Regional Emergency Training Center Facility (SBRETC) through Joint Exercise of Powers Agreement No. 98-421 (JPA Agreement) approved by the Board on June 9, 1998 (No. 49). The current members of the JPA are SBCFPD and the San Bernardino Community College District. Section 5 of the JPA Agreement provides that the parties to the JPA may use their personnel, equipment, or property in lieu of or in conjunction with other contributions or advances.
SBCFPD has access to subject matter experts in the field of ARFF who are qualified and certified through the State of California to instruct and certify participants in the field of ARFF. SBCFPD also has access to other equipment and specialists commonly used during the course of ARFF training, specifically Self-Contained Breathing Apparatus (SCBA).
Approval of the Agreement for the Temporary Transfer of Equipment (Agreement) will allow SBCFPD to temporarily transfer possession of SBCFPD-owned SCBAs and other equipment as provided for in the Agreement at no cost to JPA for use by JPA during training courses held at SBRETC. The Agreement will allow SBCFPD staff to attend training required for initial and mandatory recurrent training to qualify as firefighters at airports classified by the Federal Aviation Administration. The Agreement will also allow SBCFPD staff who attend required training to have access to equipment that is the same or similar to that which is used during the course of their normal duties as firefighters at airports classified by the Federal Aviation Administration.
Approval of the Agreement will provide for the safety, health, and social service needs of County and SBCFPD residents by enhancing the emergency response capabilities of SBCFPD and other local fire agencies that attend SBRETC’s ARFF training. The term of the Agreement is from March 15, 2022 through March 14, 2027. The Agreement may be terminated by either party upon 30 days’ written notice.
