Recommendation
1. Approve Amendment No. 1 to Contract No. 24-763 with Rasmussen Brothers Construction, Inc., adding to the scope of work and increasing the total contract amount by $206,924, from $2,325,000 to the new total amount of $2,531,924, for the Prado Regional Park Gatehouse and Monument Sign Replacement Project in Chino, with no change to the contract term of 548 calendar days (Four votes required).
2. Approve Change Order No. 1 to Contract No. 24-763 with Rasmussen Brothers Construction, Inc., adding to the scope of work and increasing the contract amount by $43,649, from $2,531,924 to the new total amount of $2,575,573, for the Prado Regional Park Gatehouse and Monument Sign Replacement Project in Chino, with no change to the contract term of 548 calendar days (Four votes required).

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The cost of the amendment and change order will be covered by the budget for the Prado Regional Park Gatehouse and Monument Sign Replacement Project (Project) (WBSE 10.10.1257), as approved by the Board of Supervisors (Board) on August 20, 2024 (Item No. 56).

BACKGROUND INFORMATION
The Project replaces the outdated gatehouse at Prado Regional Park and adds a new, modern monument sign. The gatehouse has reached its intended life cycle and needs to be replaced and updated with a staff restroom. The new entry gatehouse and monument sign aligns with the County and Chief Executive Office’s goals and objectives to provide improved amenities and aesthetic appearance of Prado for staff, visitors, and the surrounding community.
On April 9, 2024 (Item No. 33), the Board authorized the Project and Facilities Management Department (PFMD) to solicit competitive bids for the Project.
On August 20, 2024 (Item No. 56), the Board awarded Contract No. 24-763 (Contract) in the amount of $2,325,000 to Rasmussen Brothers Construction, Inc. (Contractor), the lowest responsive and responsible bidder.
Approval of Amendment No. 1 to the Contract will increase the contract amount by $206,924 to cover unanticipated additional costs resulting from design omissions and out-of-scope work. The unanticipated additional costs in the amendment are attributable to required design changes, including the failure of the plans and specifications to include the required excavation of stormwater Best Management Practice (BMP) basins and miscalculations in the contract drawings for electrical distribution, as well as vandalism to the temporary automated gates during non-working hours. Approval of Amendment No. 1 will allow the excavation and placement of a BMP basin, repairs to vandalized temporary automated gates, and the installation of a larger transformer, which includes the demolition of an existing switchgear pad and enclosure, and trenching to connect the new switchgear to an existing pull-box.
Approval of Change Order No. 1 to the Contract will increase the total contract amount by $43,649 to cover additional work not included in the original contract, including implementation of the Storm Water Pollution Prevention Plan necessitated by excessive rainfall, and the procurement and installation of temporary automated gates requested by Regional Parks staff. Due to the existing irrigation main line being routed beneath the proposed new entry roadway, the change order also includes the cost to reroute the line as requested by Regional Parks staff.
This Project is consistent with County Administrative Office approved Capital Improvement Program Project request No. 22-074
Public Contract Code section 20136 requires all construction contract amendments and change orders to have four-vote approval by the Board.
