Recommendation
1. Acting as the governing body of Board Governed County Services Areas providing park and recreations services:
a. Conduct a public hearing on proposed ordinance relating to rules and regulations for park and recreation services and repealing Ordinance No. SD 75-6 and Ordinance No. SD 79-1.
b. Make alterations, if necessary, to proposed ordinance.
c. Approve introduction of proposed ordinance.
d. Read title only of proposed ordinance; waive reading of entire text and SCHEDULE FOR FINAL ADOPTION ON TUESDAY, MARCH 10, 2020 on the Consent Calendar.
2. Acting as the governing body of Big Bear Valley Recreation and Park District:
a. Conduct a public hearing on proposed ordinance relating to rules and regulations for park and recreation services and repealing Ordinance No. SD 75-6 and Ordinance No. SD 79-1.
b. Make alterations, if necessary, to proposed ordinance.
c. Approve introduction of proposed ordinance.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as any costs associated with this proposed ordinance would be funded by the Board Governed County Services Areas providing park and recreations services, Big Bear Valley Recreation and Park District, and/or Bloomington Recreation and Park District (Districts).
BACKGROUND INFORMATION
San Bernardino County Special Districts Department manages and operates the Districts, which provide recreation and park services for several communities within the county.
On August 25, 1975, the Board of Supervisors (Board) adopted San Bernardino County Ordinance SD No. 75-6, “An Ordinance providing rules and regulations for Park and Recreation Districts governed by the Board of Supervisors, County of San Bernardino, and County Service Areas with Park and Recreation Powers”. This ordinance was designed to be incorporated into signs encouraging desired activity and posted prominently throughout the parks and its facilities.
On February 12, 1979, the Board adopted Ordinance SD No. 79-1 that amended Ordinance No. 75-6 by authorizing the “use and possession of alcoholic beverages under specified conditions.”
Although the existing rules and regulations in Ordinance SD No. 75-6 and Ordinance SD No. 79-1 are still appropriate for the types of activities and common uses of park facilities, they are in need of some augmentation to address current issues.
Over time, visitors to recreation and park facilities have gained access to a variety of recreation devices and “toys” which represent an additional liability to the County and Districts when being used at facilities owned by Districts. The use of bounce houses, slip and slides, inflatable pools, slack-line equipment, remote-controlled devices, a variety of weapons and firearms to include paintball, air-soft, BB guns, pellet guns, or wrist rockets present challenges not identified in the previous ordinances. New verbiage for this proposed ordinance addresses these areas of concern, as well as defines other specific areas relevant to today’s park user such as prohibiting the smoking or vaping of any substance, legal or illegal. The addition of these clarifications will assist in keeping the public safe while participating in healthy outdoor activities at recreation and park facilities, as well as provide law enforcement personnel with justification for enforcing the law.
This item meets the previously stated Goal and Objective by further defining acceptable public park uses and prohibiting negative or unsafe uses of public parks.
