Recommendation
1. Acting as the governing body of the County of San Bernardino, approve Assignment and Consent to Assignment of Contract No. 17-542, for heavy equipment rental services, from All-Pro Equipment Rental, Inc. to All-Pro Sweeping, Inc.
2. Acting as the governing body of the San Bernardino County Flood Control District, approve Assignment and Consent to Assignment of Contract No.17-575, for heavy equipment rental services, from All-Pro Equipment Rental, Inc. to All-Pro Sweeping, Inc.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as it only approves and consents to the assignment of existing contracts from All-Pro Equipment Rental, Inc. to All-Pro Sweeping, Inc. Sufficient appropriation related to the existing contracts has been included in the County of San Bernardino Department of Public Works Road Operations and the San Bernardino County Flood Control District (District) 2019-20 budgets and will be included in future recommended budgets.
BACKGROUND INFORMATION
On June 27, 2017 (Item No. 87), the Board of Supervisors (Board) approved contracts with 33 vendors to be on the County and District’s on-call heavy equipment rental services list. This item included the contracts with All-Pro Equipment Rental, Inc. in an amount not-to-exceed $750,000 for the County and $250,000 for the District. Subsequent Board actions pertaining to the County’s contracts with All-Pro Equipment Rental, Inc. are as follows:

The contracts provide that they are not assignable, in whole or in part, without the prior written consent of the County and the District.
On September 3, 2019, the County and District were notified that All-Pro Equipment Rental, Inc. restructured and will be operating as a new entity under the name All-Pro Sweeping, Inc. All-Pro Sweeping, Inc. has agreed to accept all obligations, responsibilities, and duties under the above referenced contracts.
