RECOMMENDATION(S)
Recommendation
1. Approve Amendment No. 2 to Contract No. 23-145 with Axon Enterprise, Inc., for the provision of a Body Worn Camera System, including hardware, software, and data storage, increasing the total contract amount by $2,760,246, from $7,807,586 to an amount not to exceed $10,567,832, without change to the original contract term of March 1, 2023 through February 29, 2028, with the option to extend the term for one additional two-year period, or two additional one-year periods.
2. Authorize the Sheriff/Coroner/Public Administrator or Undersheriff to execute change orders to the contract, as needed, subject to review by County Counsel, as long as the total aggregate amount of such change orders does not exceed $739,748, 7% of the total contract amount, and the change orders do not amend the contract term.
3. Direct the Sheriff/Coroner/Public Administrator or Undersheriff to transmit all change orders to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
Approval of this item may result in the use of additional Discretionary General Funding (Net County Cost). The cost for additional Body Worn Camera System (BWCS) cameras and components for years two and three of Contract No. 23-145 (Contract) with Axon Enterprise, Inc. (Axon), in the aggregate amount of $1,002,742, will be partially funded through Byrne Discretionary Grants Program funding, in the amount of $893,350. On September 24, 2024 (Item No. 76), the Board of Supervisors (Board), approved both the acceptance of Byrne Discretionary Grants Program funding and an adjustment to the Sheriff/Coroner/Public Administrator’s (Department) 2024-25 budget. A request for additional Discretionary General Funding for the remaining $109,392 is not included at this time but may be submitted to the Board for approval in the future, if necessary. The cost for additional BWCS cameras and components for years four and five of the Contract totals $878,752 annually. Sufficient appropriation for years four and five will be included in future recommended budgets.
BACKGROUND INFORMATION
A BWCS is an effective resource that captures unalterable audio and video of daily interactions between Sheriff Department personnel and citizens, including use of force, and can be used as evidence in criminal cases. It can improve evidentiary outcomes, expedite case and/or incident resolutions, increase personnel and community safety, and increase public transparency while improving interactions between the Department and the public.
Approval of Recommendation No. 1 will increase the total Contract award by $2,760,246 for 700 additional cameras and other BWCS components and applicable services, to be utilized within the Department’s Type II Detention Facilities, without changes to the original Contract period.
Approval of Recommendation No. 2 will allow the Sheriff/Coroner/Public Administrator or Undersheriff to address changes in BWCS equipment and/or service needs. Any such change order shall not exceed $739,748, 7% of the total Contract amount of $10,567,832, nor amend the Contract’s term.
On February 28, 2023 (Item No. 66), as a result of a competitive procurement, the Board approved the Contract with Axon for the provision of a BWCS, for the period of March 1, 2023 through February 29, 2028, with the option to extend the term for one additional two-year period, or two additional one-year periods.
After the initial deployment and testing of the cameras and other components, it was determined that some equipment and components originally included in the Contract were not needed. Those items were returned to Axon for a credit that was used to reduce the cost of 201 additional cameras and components included in Amendment No. 1 to the Contract, approved by the Board on June 25, 2024 (Item No. 115), that increased the Contract’s total amount by $1,246,251 from $6,561,335 to $7,807,586, with no changes to the original Contract period.
