RECOMMENDATION(S)
Recommendation
1. Approve Addendum No. 1 to the bid documents, issued on March 3, 2021, for the construction of the Mid-Valley Sanitary Landfill Unit 4 Phase 2 Initial Grading Project.
2. Approve Addendum No. 2 to the bid documents, issued on March 15, 2021, for the construction of the Mid-Valley Sanitary Landfill Unit 4 Phase 2 Initial Grading Project.
3. Award a construction contract in the amount of $637,414 to Jeremy Harris Construction, Inc. (Riverside, CA) for the construction of the Mid-Valley Sanitary Landfill Unit 4 Phase 2 Initial Grading Project.
4. Authorize a contingency fund of $63,741 for the Mid-Valley Sanitary Landfill Unit 4 Phase 2 Initial Grading Project.
5. Authorize the Director of the Department of Public Works to approve the expenditure of the contingency fund of $63,741 for verified quantity overruns for this unit priced construction contract.
6. Authorize the Director of the Department of Public Works to order any necessary changes or additions in the work being performed under the contract for a total amount not-to-exceed $44,370 pursuant to Public Contract Code section 20142.
7. Authorize the Director of the Department of Public Works to accept the work when 100% complete and execute and file the Notice of Completion.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as the Department of Public Works - Solid Waste Management Division (SWMD) is financed by fee revenue. SWMD establishes fees that are charged to the public and other agencies for utilization of the County’s Waste Disposal System. The construction contract of $637,414 and any use of the proposed contingency fund for the Mid-Valley Sanitary Landfill Unit 4 Phase 2 Initial Grading Project (Project) will be funded by SWMD fee revenue. Sufficient appropriation and revenue have been included in the SWMD 2020-21 budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
The County's Mid-Valley Sanitary Landfill (MVSL) is located in the City of Rialto, northwest of the intersection of Alder Avenue and State Route 210. The site occupies approximately 448 acres of which 408 are permitted for refuse disposal. The site is divided into five separate waste management units. This Project will enable SWMD to properly manage the site and prevent disruptions in future disposal activities. The Project consists of preliminary grading of Unit 4 slopes and bench roads in advance of the installation of the geomembrane liner and appurtenant infrastructure in this immediate vicinity. The construction of a foundation pad will provide space for additional environmental control equipment, including an upgraded landfill gas (LFG) treatment facility, drainage infrastructure and other operational considerations needed to continue waste filling operations in the Unit 4 landfill cell.
The Project meets the County and Chief Executive Officer’s goals of improving County government operations by creating needed waste disposal capacity in a manner that protects adjacent land and groundwater from potential pollution resulting from landfilling operation and providing for the safety, health and social service needs of County residents by the collection and control of LFG emissions and associated pollutants.
Following Board of Supervisors (Board) approval of this item, construction is anticipated to commence in June of 2021 and be completed in the Fall of 2021.
PROCUREMENT
This Project was released on the County Electronic Procurement Network (ePro) on February 10, 2021 and advertised in The Daily Press and The Precinct Reporter on February 11 and 18, 2021. A notice inviting bids was also provided to specified construction trade journals as required by Public Contract Code section 22036. A mandatory pre-Bid meeting and job walk was held on Wednesday, February 24, 2021 and was attended by 17 firms.
There were two addendums issued during the bidding phase, revising the Project plans and specifications as follows:
• Amending Special Provisions relating to Traffic Control and providing responses to questions submitted (March 3, 2021).
• Increasing the working days to a total of 60 days (March 15, 2021).

SWMD has reviewed the bids received and determined that they are responsive and recommends the Board award the contract to Jeremy Harris Construction, Inc., the lowest responsible bidder. No appeal/protest letters were received.
The Project will have a total contingency fund of $63,741 to compensate the contractor for verified quantity overruns for this unit priced construction contract, as well as changes in the contract under certain circumstances. Under an established formula based on the contract amount, Public Contract Code section 20142 allows the Board to authorize the Director of the Department of Public Works to order changes in the contract, including for unforeseen conditions or design shortfalls, should they become necessary in the future for a total amount not-to-exceed $44,370 of the $63,741 contingency fund.
