RECOMMENDATION(S)
Recommendation
1. Approve the Standard Assurances for the California Governor’s Office of Emergency Services Federal Grant Programs pertaining to the Fiscal Year 2019 Emergency Management Performance Grant.
2. Approve the Standard Assurances for the California Governor’s Office of Emergency Services Federal Grant Programs pertaining to the Fiscal Year 2019 Homeland Security Grant Program.
3. Adopt Resolution, as required by California Governor’s Office of Emergency Services for the Fiscal Year 2019 Emergency Management Performance Grant, authorizing the Chairman of the Board of Supervisors, Chief Executive Officer or San Bernardino County Fire Protection District Interim Fire Chief/Fire Warden, Deputy Fire Chief, Finance Officer and/or Emergency Services Manager for the San Bernardino County Office of Emergency Services to proceed with the following actions on behalf of the County of San Bernardino:
a. Execute and file documents with California Governor’s Office of Emergency Services for submittal of the grant application.
b. Act as signatories for grant reimbursement claims, performance reports, and other documents required to administer the grant.
c. Execute any grant amendments, upon review by County Counsel, to extend the performance timelines.
4. Adopt Resolution, as required by California Governor’s Office of Emergency Services for the Fiscal Year 2019 Homeland Security Grant Program, authorizing the Chairman of the Board of Supervisors, Chief Executive Officer or San Bernardino County Fire Protection District Interim Fire Chief/Fire Warden, Deputy Fire Chief, Finance Officer and/or Emergency Services Manager for the San Bernardino County Office of Emergency Services to proceed with the following actions on behalf of the County of San Bernardino:
a. Execute and file documents with California Governor’s Office of Emergency Services for submittal of the grant application.
b. Act as signatories for grant reimbursement claims, performance reports, and other documents required to administer the grant.
c. Execute any grant amendments, upon review by County Counsel, to extend the performance timelines.
5. Authorize the officials listed in Recommendations No. 3 and No. 4 to execute and submit any non-substantive amendments, upon review by County Counsel, in relation to the Fiscal Year 2019 Emergency Management Performance Grant and Fiscal Year 2019 Homeland Security Grant Program application and subsequent grant award.
6. Direct the officials listed in Recommendations No. 3 and No. 4 to transmit all documents and amendments in relation to the fiscal Year 2019 Emergency Management Performance Grant and Fiscal Year 2019 Homeland Security Grant Program to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). Implementation of the fiscal Year 2019 Emergency Management Performance Grant (FY 19 EMPG) and Fiscal Year 2019 Homeland Security Grant Program (FY 19 HSGP) are contingent upon Cal OES’s approval of the grant applications. If funding is awarded, future items will be presented to the Board of Supervisors (Board) to accept the grant funds in accordance with County Policy 05-13.
EMPG
The State of California is allocating a total of $15,481,623 to various Operational Areas statewide as subrecipients for the FY 19 EMPG. As determined by a formula established by Cal OES, which includes a base amount and per-capita component, the allocation for the San Bernardino County Operation Area (OA) is $563,893. These funds will be distributed to the San Bernardino County Office of Emergency Services (OES) and participating cities/towns within the County for projects that align with the goals of the EMPG Program. Allocations to the participating cities/towns will be based on a per capita formula. A small portion of the grant funds ($28,195 or 5%) will be allocated to OES, as the San Bernardino County OA Lead Agency, for grant management and administration. This grant requires a dollar-for-dollar match, which can be accomplished through cash or in-kind services.
HSGP
The State of California has been allocated a total of $62,011,000 for the FY 19 HSGP. Of this amount, the estimated allocation for the San Bernardino County OA is approximately $2,300,000 based on the same formula used to calculate the FY 19 EMPG allocation. These funds will be distributed to OES, the San Bernardino County Fire Protection District, other county departments/agencies, and participating cities/towns within the county for projects that align with the goals of the HSGP Program. Five percent of the grant funds will be allocated to OES for grant management and administration. There are no matching funds required with this grant.
Appropriation and revenue related to these grants are included in the 2019-20 budget for OES and will be included in future recommended budgets as needed.
BACKGROUND INFORMATION
The San Bernardino County OA was established as an intermediate level of the State’s emergency services organization to manage and/or coordinate emergency preparedness efforts within the county. OES has been receiving HSGP and EMPG funds annually since 1999 and 2004, respectively, to assist with this purpose. Board approval of this item is needed to obtain these grant funds for an additional year. More information about each grant follows:
EMPG
The EMPG, which is overseen by the Department of Homeland Security/Federal Emergency Management Agency, provides funding to support comprehensive emergency management programs at the state, tribal and local levels and to encourage the improvement of mitigation, prevention, protection, preparedness, response and recovery capabilities for all emergencies and disasters (whether natural or man-made). The performance period of this grant is from July 1, 2019 through June 30, 2021. Grant funding is allocated to the participating cities/towns based on a per capita formula.
HSGP
The HSGP, which is also overseen by the Department of Homeland Security/Federal Emergency Management Agency, was established to strengthen the nation’s homeland security preparedness. This grant allows the San Bernardino County OA to continue its efforts of guarding against terrorism, responding to other catastrophic events, and improving disaster readiness/response/recovery. The performance period of this grant is from September 1, 2019 through August 31, 2022. Proposed projects for FY 19 HSGP funding, which were collected by OES from all San Bernardino County OA jurisdictions, were approved by the OA’s Approval Authority on December 19, 2018. However, the projects and allocations may be adjusted once Cal OES has finalized the Financial Management Forms Workbook (FMFW) and the County’s grant allocation.
Pursuant to County Policy 05-13, Board approval of the “Standard Assurances for the Cal OES Federal Grant Programs” pertaining to the FY 2019 EMPG and FY 19 HSGP is needed because these documents legally bind the County to the grant program and are required as part of the application process. Additionally, a resolution delegating authority for management of the grant process is required by Cal OES and is also sensible because of the short timeframe allocated by Cal OES for return of the FMFW once the California Supplement to the Federal Notice of Funding Opportunity has been issued.
As mentioned previously, the performance period for the FY 2019 EMPG and FY 19 HSGP began on July 1, 2019 and September 1, 2019, respectively. Board approval of this item is retroactive to those dates because OES just recently received the standard assurance documents from Cal OES for these grants on August 29, 2019. This item is being presented to the Board at this time as this is the first date available for presentation following the required operational, fiscal, and legal reviews.
