Recommendation
Acting as the governing body of the San Bernardino County Fire Protection District, adopt a Resolution acknowledging receipt of the 2023-24 Compliance Report (Exhibit A) prepared by the San Bernardino County Fire Protection District regarding the inspection of certain occupancies requiring annual inspections pursuant to California Health and Safety Code sections 13146.2, 13146.3, and 13146.4.

Adoption of this Resolution will not result in the use of Discretionary General Funding (Net County Cost) as there are no costs associated with the receipt of this annual report.
BACKGROUND INFORMATION
California Health and Safety (H&S) Code sections 13146.2 and 13146.3 require every fire department or fire district to annually inspect every building used as a public or private school, hotels, motels, lodging houses, and apartment complexes for compliance with building standards and other regulations of the State Fire Marshal. Section 13146.4 requires every fire district, including the San Bernardino County Fire Protection District (SBCFPD), to report their compliance with the annual inspection requirements of the H&S Code to its administering authority annually. Section 13146.4 also requires the administering authority to formally acknowledge receipt of the compliance report in a resolution or a similar formal document. On October 27, 2020 (Item No. 90), the Board of Directors (Board) directed the Fire Chief/Fire Warden to prepare the compliance report annually and present it for receipt and acknowledgement by the Board within 120 days from the end of each fiscal year. The compliance report is presented to the Board annually, with the last report presented to the Board on October 3, 2023 (Item No. 56).
This item adopts a Resolution acknowledging receipt of the 2023-24 Compliance Report (Exhibit A) regarding the inspection of occupancies requiring annual inspections pursuant to sections 13146.2, 13146.3, and 13146.4 of the H&S Code. Exhibit A identifies the following:
• The annual inspection of:
o 318 of 318 public or private school occupancies, buildings, structures and/or facilities (collectively referred to as School Inspections).
o 2,198 of 2,251 apartments, hotels, motels and all other multi-family housing occupancies, buildings, structures and/or facilities (collectively referred to as Multi-Family Housing Inspections).
• For the reporting period, the inspections represent a compliance rate of 100% for School Inspections and 98% for Multi-Family Housing Inspections.
SBCFPD did not achieve 100% inspections for various reasons, including inadequate staffing resources due to vacancies and the subsequent training required for new hires to provide optimal productivity as inspectors. SBCFPD intends to prioritize 100% compliance for 2024-25 with fully trained staff and full access to all occupancies requiring inspections, and a focus on addressing any missed inspections in the new fiscal year.
