RECOMMENDATION(S)

Recommendation

Acting as the governing body of the Bloomington Recreation and Park District:

1.                     Conduct a public hearing on the following proposed ordinances:

                     Proposed ordinance to establish various recreation and park activity fees for Fiscal Year 2023-24 and to repeal Ordinance No. 23-03.

                     Proposed ordinance to adopt by reference Sections 52.0130, 53.0603, 53.0604, 53.0605, 53.0606, and 53.0607 of the San Bernardino County Code and add new regulations relating to electric vehicle charging station fees and time limits for District parking lots.

2.                     Make alterations, if necessary, to the proposed ordinances.

3.                     Approve introduction of proposed ordinances.

                     An ordinance of the Bloomington Recreation and Park District to establish various recreation and park activity fees for Fiscal Year 2023-24 and to repeal Ordinance No. SD 23-03.

                     An ordinance of the Bloomington Recreation and Park District to adopt by reference Sections 52.0130, 53.0603, 53.0604, 53.0605, 53.0606, and 53.0607 of the San Bernardino County Code and add new regulations relating to electric vehicle charging station fees and time limits for District parking lots.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). Although the vast majority of ongoing funding for the Bloomington Recreation and Park District (District) is derived from property taxes, the District does receive annual fee revenue to help fund the costs of providing service. The estimated amount of revenue from fees for 2023-24 is $143,000. This amount includes approximately $18,000 from new fees, primarily the electric vehicle (EV) charging station fee, that are within the proposed fee ordinance. Appropriation and revenue adjustments related to the updated fee ordinance will be included in the District’s 2023-24 Mid-Year Budget Report, as needed.  

 

 

 

BACKGROUND INFORMATION

On April 25, 2023 (Item No. 74), the Board of Directors (Board) adopted the District’s fee ordinance for Fiscal Year 2023-24 (Ordinance No. 23-03).  Since that time, the District has identified the need for additional fees for the use of new amenities at Kessler Park including the snack bar, batting cages, and the “Dream Field”. Additionally, the proposed fee ordinance includes new fees for tasks that staff started conducting, such as the preparation of playing fields, along with updated deposit fees to ensure full recovery of damages, if necessary.

 

The proposed fee ordinance also adds an EV charging station user fee in connection with the use of EV charging stations located at Ayala Park, as well as a provision allowing the Director of Public Works to adjust, as necessary, the amount of charge station fees based on the actual cost of electricity. This will provide flexibility at the staff level to adapt to market fluctuations in real-time, which would otherwise require Board action to change the fee. The revenue from this new fee will be used to fund the cost of a contract with ChargePoint, Inc. (ChargePoint) for operations and maintenance of the EV charge stations at Ayala Park. Upon Board approval of this item, the Department of Public Works - Special Districts (Department) plans to present a separate item at the October 3, 2023, meeting to seek approval of the contract with ChargePoint.

 

Approval of this item will also introduce an ordinance that adopts portions of the San Bernardino County Code applicable to regulation of District owned or maintained parking lots, as well as add new regulations relating to electric vehicle charging station fees and time limits for District parking lots.

 

The Department ensures that the recommended fee amounts comply with Proposition 26. Proposition 26 generally requires fees not to be higher than the cost of the activity and/or services provided, unless an exception applies as provided in the proposition. The District’s fees do not provide for full cost recovery as the District receives the aforementioned property tax revenue for the purpose of providing recreation and park services.

 

The proposed ordinances will take effect on November 2, 2023, following final adoption by the Board on Tuesday, October 3, 2023.
