Recommendation
1. Approve plans and specifications for the Americans with Disabilities Act ramp and sidewalk project on various roads in the Montclair area (Project), as signed and sealed by a registered civil engineer.
2. Authorize the Director of Public Works to advertise the Project for bids.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Department of Public Works (Department) is funded by Gas Tax revenues, fees and other state and local funding. The Project is funded with Community Development Block Grant (CDBG) funds and Gas Tax. Sufficient appropriation and revenue are included in the 2019-20 Road Operations budget (6650002000 20H14980).
BACKGROUND INFORMATION
The Project involves replacing 14 existing non-compliant curb ramps and constructing 13 new curb ramps at various locations along Grand Avenue, Ninth Street, and Mission Boulevard in the Montclair area, in accordance with current design standards and pursuant to the Americans with Disabilities Act (ADA), as well as reconstructing spandrels and cross-gutters. The Project also includes 516 feet of road widening on Grand Avenue with the installation of curb, gutter and sidewalk to fill the gap between the new curb ramp at the southwest corner of Grand Avenue and Pipeline Avenue and the existing sidewalk to the west. This Project aligns with the County and Chief Executive Officer’s goals of ensuring development of a well-planned, balanced, and sustainable County and providing for the safety of County residents by improving access for all pedestrians, including those with disabilities.
The acquisition of additional right-of-way for Assessor’s Parcel No. 1013-031-11 for the sidewalk construction on Grand Avenue has not been completed at this time; however, the Department will proceed with construction due to a funding deadline with the CDBG grant. It is anticipated the right-of-way acquisition will be complete prior to construction and if not, the Department will proceed with constructing the sidewalk without this portion and complete it once the right-of-way is acquired.
Annually, the County receives an allocation of CDBG funds for expenditure on projects that benefit low-income areas. The Project to construct the subject curb ramps to the most current ADA design standards was identified as a priority project eligible to receive CDBG funds. Also, this Project was selected because the subject curb ramps and sidewalk will be constructed within the Safe Route to School Plan in the Montclair area.
The Project’s specifications includes an allowance, in the amount of $10,000 for differing site conditions associated with utilities.
On August 13, 2018, the County’s Department of Community Development and Housing completed the National Environmental Policy Act review of the Project pursuant to delegated authority from the Housing and Urban Development.
On October 8, 2019 (Item No. 30), the Board of Supervisors determined the Project was exempt under the California Environmental Quality Act, approved the Project as defined in the Notice of Exemption, and directed the Clerk of the Board to file and post said notice.
PROCUREMENT
The Project will be advertised for bids in accordance with section 22037 of the California Public Contract Code as well as federal procurement standards governing the use of CDBG funds. The Department anticipates returning to the Board for an award of contract in January of 2020.
