Recommendation

Approve non-financial Memorandum of Understanding with Azusa Pacific University, including non-standard terms, for training and field experience for students in the nursing student internship program for the period of August 10, 2022 through July 31, 2025.

FINANCIAL IMPACT

The recommended Memorandum of Understanding (MOU) is non-financial in nature and as such, does not impact Discretionary General Funding (Net County Cost).

 

BACKGROUND INFORMATION

The recommended MOU with Azusa Pacific University (APU) will allow the Preschool Services Department (PSD) to provide training and field experience to interns in the Nursing program at APU. Through the student internship program, PSD provides learning experiences that provide student interns with the skills they need to prosper in the twenty-first century economy, which aligns with the San Bernardino Countywide Vision2Succeed initiative.

 

PSD employs qualified professionals who will provide the needed tutelage and guidance to student interns participating in the Nursing Program, where the focus of study is on community health education and services. Interns will assist in providing hearing, vision, and hemoglobin screenings to PSD enrolled children. The interns will also provide parent education classes in areas such as chronic health conditions and reducing the spread of communicable diseases. PSD's population of approximately 3,898 children ages 0 to 5 throughout San Bernardino County will afford APU interns required field experience and internship hours while maximizing PSD’s available public resources.

 

PSD utilizes a Board of Supervisors (Board) approved student internship agreement template with several agencies countywide. APU requirements differ from the Board-approved student internship agreement template regarding indemnification.  The APU contract includes terms that differ from the standard County contract terms. The non-standard terms include the following:

 

The MOU with APU limits its indemnification obligations to claims arising from their own negligent acts and willful misconduct, and its indemnity obligations will not extend to claims that arise from the negligent acts, errors or omissions, or willful misconduct of County employees.

                     The County standard contract indemnity provision requires the Contractor to indemnify, defend, and hold the County harmless from third party claims arising out of the acts, errors, or omissions of any person.

                     Potential Impact:  The limit of the indemnification obligation to APU’s negligence or willful misconduct means that any claim that does not require these conditions are excluded from APU’s indemnification obligations.

 

APU’s performance will be monitored by review of monthly reports to ensure compliance with the administrative and program requirements of the MOU. APU will cooperate with the County in the implementation, monitoring, and evaluation of this MOU and comply with any and all reporting requirements established by this MOU. The MOU may be terminated without cause by the County with 30 days written notice.
