Recommendation
1. Acting as the governing body of the County of San Bernardino, approve Amendment No. 2 to Memorandum of Understanding (MOU) No. 15-334 between the Sheriff/Coroner/Public Administrator (Sheriff) and County Service Area 70 Countywide (CSA 70), exercising the second of three one-year options to extend the term, for a new total agreement period of July 1, 2015 through June 30, 2022, and increasing the compensation amount by $22,215 (from $136,255 to $158,470) for the Sheriff to continue to reimburse CSA 70 for the cost of providing operations, maintenance and management of the County-owned wastewater collection system located at the Glen Helen Rehabilitation Center (GHRC).

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). In accordance with this recommended amendment, the Sheriff shall reimburse CSA 70 an amount not to exceed $22,215 for the cost of the subject services during 2021-22. This amount reflects no change from the prior fiscal year. Both the Sheriff and CSA 70 will include adequate appropriation and revenue in their respective 2021-22 recommended budgets to support this amendment.
BACKGROUND INFORMATION
The GHRC, located at 18000 Institution Road in San Bernardino, is a facility that houses both male and female inmates. The Sheriff is responsible for ensuring that operation, maintenance, and management of the facility’s wastewater collection system is conducted according to federal, state and local regulatory requirements. Since the Sheriff does not employ certified operators to provide these services, on June 16, 2015 (Item No. 87), the Board of Supervisors (Board) approved MOU No. 15-334 allowing the Department of Public Works - Special Districts (Special Districts), through CSA 70, to perform system operation, maintenance, and management at the GHRC from July 1, 2015 through June 30, 2020. On January 5, 2021 (Item No. 50), the Board approved Amendment No.1 that extended the MOU term by one year through June 30, 2021.
Language in the MOU allows the term to be extended for three one-year increments through mutual agreement of the parties. Approval of this item (Amendment No. 2) would exercise the second of three one-year options to extend the term, allowing CSA 70 to continue to provide service for the Sheriff through June 30, 2022. This action is recommended because CSA 70 staff has the certification and experience necessary to ensure public health and safety by meeting all regulatory requirements.
