Recommendation
Acting as the governing body of the San Bernardino County Fire Protection District:
1. Find that approval of a license agreement with the United States of America, for multiple San Bernardino County Fire Protection District Fire Stations is an exempt project under the California Environmental Quality Act Guidelines Section 15301 - Existing Facilities (Class 1) and benefits the San Bernardino County Fire Protection District by protecting lives and property.
2. Approve a license agreement with the United States of America for Department of the Army training operations, for the use of Fire Station 11 located at 2929 El Mirage Road in El Mirage, Fire Station 52 located at 39059 Kathy Lane in Harvard, Fire Station 53 located at 72734 Baker Boulevard in Baker, Fire Station 56 located at 37284 Flower Road in Hinkley, and Fire Station 57 located at 83732 Trona Road in Trona for no cost or revenue, for the period of January 1, 2024 through December 31, 2027.
3. Direct the Secretary of the Board of Directors to file and post the Notice of Exemption for the project as required under the California Environmental Quality Act.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). There is no cost or revenue associated with this four-year license agreement.
BACKGROUND INFORMATION
The license agreement will allow the United States of America Department of the Army (US Army) to conduct training operations for the period of January 1, 2024 through December 31, 2027, at the following occupied San Bernardino County Fire Protection District (SBCFPD) stations, Fire Station 11 located at 2929 El Mirage Road in El Mirage, Fire Station 52 located at 39059 Kathy Lane in Harvard, Fire Station 53 located at 72734 Baker Boulevard in Baker, Fire Station 56 located at 37284 Flower Road in Hinkley, and Fire Station 57 located at 83732 Trona Road in Trona (Properties).
The US Army training operations will take place on various days throughout the term, which will not impact SBCFPD operations. The US Army will provide SBCFPD with 30-day notice prior to the date of training. The training operations may include tactical movement of soldiers in and around the Properties, rotary wing military training, including but not limited to the following: tactical approaches, tactical landings, hovering, fast rope insertion extraction system training, loading and unloading of personnel and equipment, tactical take-offs and tactical departures utilizing military aircraft to include rotary wing. The dates of training and the specific training activities that will be conducted pursuant to the license agreement will be discussed and agreed to between SBCFPD, through its Fire Chief or his designee, and the US Army prior to the training.
SBCFPD requested that the Real Estate Services Department (RESD) prepare a license agreement for the US Army’s use of the Properties for training operations. The license agreement will allow the US Army to perform tactical training operations to continue to provide public safety. SBCFPD will be permitting the US Army to use its Properties at no cost as the license agreement benefits SBCFPD by protecting lives and property. More specifically, by allowing the US Army to use its Properties during US Army training activities, it will allow the US Army to better respond to any calls for emergency services, including fire and emergency medical services, from its personnel arising out of US Army training operations.
The project to approve a license agreement with the US Army was reviewed pursuant to the California Environmental Quality Act (CEQA) and determined to be categorically exempt under CEQA Guidelines Section 15301 - Existing Facilities (Class 1) because the license agreement will operate within the existing facilities with negligible or no expansion of existing use.
