Recommendation
Approve Memorandum of Understanding with San Bernardino County Transportation Authority (Agency Contract No. 22-1002801), including non-standard terms, for the implementation of the Safe Routes to School Program in the amount of $200,000 for the contract period of July 1, 2022 through June 30, 2025.

FINANCIAL IMPACT
This item does not impact Discretionary General Funding (Net County Cost). The Department of Public Health (DPH) will contribute $200,000 as a local match sourced from 1991 Realignment funds. The San Bernardino County Transportation Authority will be providing an additional $325,000 and the San Bernardino County Superintendent of Schools will be providing an additional $100,000 to support the program. Adequate appropriation and revenue will be included in DPH’s 2022-23 recommended budget and in future recommended budgets.
BACKGROUND INFORMATION
There is an identified national decline in children walking and biking to school, as well as a national trend toward childhood obesity and inactivity. The Safe Routes to School (SRTS) program is intended to allow students to walk and bike to school and other destinations more safely, thus encouraging increased physical activity. This program supports the County vision of working with other agencies while aligning with the Community Vital Signs initiative.
Under the terms of the Memorandum of Understanding (MOU), San Bernardino County Transportation Authority (SBCTA) will work with a consultant to plan, organize and implement the SRTS program to educate, encourage, enforce, and evaluate walking and bicycling among students, parents, and staff at select schools throughout the County. They will also coordinate SRTS activities with local transportation staff and local law enforcement. In addition, SBCTA is expected to deliver pedestrian and bicycle safety information, including the health and academic advantages of active living. Either party may terminate the agreement without cause with 30 days written notice. Both SBCTA and DPH will develop and implement procedures to administer and document program participation, compliance, and effectiveness.
The MOU was approved by SBCTA’s Board on April 13, 2022.
The MOU with SBCTA includes the following terms that differ from the standard County contract terms:
The agreement does not require SBCTA to meet the County’s insurance or indemnity standards as required pursuant to County Policy 11-07.
• The County standard contract requires contractors to carry appropriate insurance at limits and under conditions determined by the County’s Risk Management Department.
• Potential Impact: The Agreement does not include County standard insurance or indemnity requirements. However, SBCTA is a self-insured public entities for purposes of Professional Liability, General Liability, Automobile Liability and Workers’ Compensation and agrees through the MOU to indemnify the County from liability arising from SBCTA’s acts or omissions any which is sufficient to protect the County against liabilities arising out of the performance of the terms, conditions or obligations of this Agreement.
DPH recommends approval of this item, including non-standard terms, to implement a collaborative effort with SBCTA for a SRTS program in the County.
