RECOMMENDATION(S)

Recommendation

Acting as the governing body of the San Bernardino County Fire Protection District:

1.                     Approve non-financial Use Agreement with San Bernardino County for use of San Bernardino County Fire Protection District facilities by the Registrar of Voters to administer elections, including use as polling places, election supply depot sites, early voting sites, and/or poll worker training locations for the period of March 24, 2026 through July 8, 2029, at no cost to the Registrar of Voters.

2.                     Find that the non-financial Use Agreement benefits the San Bernardino County Fire Protection District by providing suitable and convenient election facilities to San Bernardino County Fire Protection District and County residents.

FINANCIAL IMPACT

Approval of this agreement will not result in the use of Discretionary General Funding (Net County Cost) as this is a no cost agreement.

 

BACKGROUND INFORMATION

On July 9, 2024 (Item No. 46), the San Bernardino County Board of Supervisors adopted a resolution, pursuant to Government Code section 25350.51, authorizing the Purchasing Agent to execute Use Agreements for facilities needed by the San Bernardino County Registrar of Voters (ROV) to administer elections, including use as polling places, election supply depot sites, early voting sites, and poll worker training locations for a term not to exceed four years.

 

ROV conducted location assessments and determined that San Bernardino County Fire Protection District (SBCFPD) has suitable and convenient facilities that may serve these purposes. SBCFPD is recommending that these facilities be made available to ROV at no cost, provided that such use does not infringe on the original and necessary purpose of the property or interfere with SBCFPD activities.

 

Approval of the non-financial Use Agreement will allow SBCFPD to enter into the agreement with the ROV pursuant to Health and Safety Code section 13861(b) to ensure ROV has necessary locations for election purposes, thus ensuring voters throughout SBCFPD and the County have sufficient access to voting locations for the period of March 24, 2026 through July 8, 2029. Assisting ROV in their delivery of election services through the use of SBCFPD facilities at no cost is consistent with prior year election activities and benefits SBCFPD by providing suitable and convenient election facilities to SBCFPD and County residents.
