RECOMMENDATION(S)

Recommendation

Acting as the governing body of the San Bernardino County Flood Control District:

1.                     Conduct a public hearing on proposed ordinance that repeals San Bernardino County Flood Control District Ordinance No. FCD 23-01, which established the current fees, and adopts the new 2024 San Bernardino County Flood Control District Fee Ordinance that sets forth the fees to be charged by the San Bernardino County Flood Control District on and after July 1, 2024, for its various products and services.

2.                     Make alterations, if necessary, to proposed ordinance.

3.                     Approve introduction of proposed ordinance.

                     An ordinance of the San Bernardino County Flood Control District, State of California, to repeal Ordinance No. FCD 23-01 and to establish fees related to products and services.

4.                     SCHEDULE ORDINANCE FOR FINAL ADOPTION ON TUESDAY, APRIL 9, 2024, on the Consent Calendar.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). This action will allow the San Bernardino County Flood Control District (District) to establish a fee structure in order to recover costs associated with providing products and services to the public. Fees for the District are estimated to generate approximately $1.2 million in revenue for 2024-25. Sufficient appropriation and revenue will be included in the District’s 2024-25 recommended budget.

 

BACKGROUND INFORMATION

On an annual basis, the District introduces a fee ordinance to the Board of Supervisors (Board), which typically includes fee revisions, the deletion of fees, and the addition of new fees. This item will authorize the actions necessary to repeal the existing 2023 District Fee Ordinance and establish the 2024 District Fee Ordinance that sets forth the fees to be charged by the District on and after July 1, 2024, for its various products and services, in order to recover the District’s costs. This action is aligned with the Board’s goals and objectives by ensuring all fee amounts are accurate and reasonable, allowing the District to operate in a fiscally-responsible and business-like manner.

 

On April 25, 2023 (Item No. 77), the Board adopted the 2023 District Fee Ordinance No. FCD 23-01 that established the District’s current fees. The District’s fees represent the estimated cost of providing various products and services.

 

As part of the District’s annual fee review, staff reviewed the 2023 District Fee Ordinance and are proposing revisions to incorporate into the 2024 District Fee Ordinance. Following is a summary of some of the more notable changes:

 

                     Hourly classification rates are being revised due to current incumbent costs, anticipated salary and benefits changes due to Board approved MOU adjustments, and changes in the productive hours calculated by the Auditor-Controller/Treasurer/Tax Collector.

 

                     The District is also proposing to change the surplus property initial deposit fee amount to more accurately reflect the average cost associated with performing this service.

 

                     Addition and deletion of hourly classification rates for classifications changes as approved by the Board on January 24, 2023 (Item No. 65).

 

On March 12, 2024 (Item No. 54), a fee workshop with the Board was conducted to discuss the 2024-25 proposed fees. Since the presentation of the District’s fees at this workshop, no revisions have been made.

 

In accordance with Government Code Section 66016, a public hearing must be conducted prior to the approval of fees. The effective date of the new fees will be July 1, 2024.
