Recommendation

1.                     Approve Amendment No. 1 to Contract No. 24-837 with R.E. Schultz Construction, Inc., for the Glen Helen Island Tower Building Demolition and Amenity Installation in San Bernardino,  adding to the scope of work, and increasing the amount by $95,230 from $1,643,350 to $1,738,580, with no change to completion date of September 10, 2025 (Four votes required).

2.                     Approve Change Order No. 1 to Contract No. 24-837 with R.E. Schultz Construction, Inc., for the Glen Helen Island Tower Building Demolition and Amenity Installation in San Bernardino, adding to the scope of work, and increasing the amount by $1,986 from $1,738,580 to $1,740,566, with no change to completion date of September 10, 2025 (Four votes required).

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The amendment and change order remain within the approved project budget of $2,461,927 for the Glen Helen Island Tower Building Demolition and Amenity Installation (WBSE 10.10.1400), which was approved on June 11, 2024 (Item No. 110) by the Board of Supervisors (Board) as part of the 2024-25 Capital Improvement Program budget.

 

BACKGROUND INFORMATION

Approval of Amendment No. 1 (Amendment) in the amount of $95,230, will compensate R.E. Schultz Construction, Inc. (Contractor) for unanticipated costs resulting from the demolition of the existing snack bar building, which was mistakenly not included in the original bid documents, installing a new pullbox and wiring due to the damaged existing utilities discovered after construction began, and the removal of trees not included in the original demolition plans, which are affecting the foundation of the playground and require removal.

 

Approval of Change Order No. 1 (CO1), in the amount of $1,986, will compensate the Contractor for additional work of adding a pet drinking station to the new drinking fountain, which was not included in the original contract, as requested by the County.

 

On May 7, 2024 (Item No. 34), the Board authorized the Project and Facilities Management Department (PFMD) to advertise the Project for competitive bids. PFMD advertised for bids in six plan rooms and on the County Electronic Procurement Network (ePro) on May 10, 2024. PFMD also advertised for bids in the San Bernardino County Sun on May 28, 2024. 

 

On September 10, 2024 (Item No. 42), the Board awarded construction Contract No. 24-837, in the amount of $1,643,350, to the Contractor, the lowest responsive and responsible bidder.

 

The unanticipated additional costs in the Amendment and CO1 are related to events that took place after the competitive bid process, which resulted in the original contract award to the Contractor, therefore, no additional procurement activities are required.

 

Public Contract Code section 20136 requires all construction contract change orders and amendments to have four vote approval by the Board.
