Approve Amendment No. 3 to Revenue Agreement No. 10-1111, effective January 1, 2026, with the City of Claremont, for the sale of landfill airspace for the disposal of Qualifying Solid Waste into the Mid-Valley Sanitary Landfill, increasing the disposal rate, from $39.59 to $44.07 per ton, increasing the agreement amount by $5,068,050, from $11,348,000 to a total amount of $16,416,050, and exercising the last option to extend the term by five years, for a total contract term of December 14, 2010 to December 31, 2030.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost), as the Department of Public Works - Solid Waste Management Division (SWMD) is financed by fee revenue. SWMD establishes fees charged to the public and other agencies for utilization of the County’s Waste Disposal System. The City of Claremont (City) has disposed of approximately 23,000 tons of solid waste annually over the past four years. The City currently pays a disposal rate of $39.59 per ton, which will be increased to $44.07 per ton effective January 1, 2026. This rate adjustment will align the City’s rate with the County’s rate of $42.07 for in-County cities that have Waste Disposal Agreements (WDAs), plus an additional $2 and eliminates future annual adjustments based on the Consumer Price Index (CPI). The new rate will apply to all Qualifying Solid Waste delivered via transfer trailers or direct hauled, and will remain $2 above the WDA rate throughout the five-year extension, applied on a calendar-year basis (January-December), even though the gate rate and WDA rate for cities in the County follow a fiscal-year basis (July-June).
The WDA rate is capped at 85% of the County’s gate rate and will only change if the County’s gate rate increases, with the City’s rate adjustment taking effect the following calendar year.
Approval of Amendment No. 3 is expected to generate approximately $5,068,050 in total revenue for the five-year period. Sufficient appropriation and the revenue of approximately $901,774 has been included in SWMD’s 2025-26 budget and estimated future revenues will be included in future recommended budgets.
BACKGROUND INFORMATION
On December 14, 2010 (Item No. 41), the Board of Supervisors (Board) approved Agreement No. 10-1111 (Agreement) with the City for the sale of solid waste landfill airspace for a term of five years, from December 14, 2010, through December 31, 2015, with an option to extend the agreement for up to three additional five-year periods.
On June 23, 2015 (Item No. 69), the Board approved Amendment No. 1 to the Agreement, for the sale of solid waste landfill airspace, which extended the term five years through December 31, 2020, exercising the first option to extend the Agreement and increasing the Base Rate to $29.12 per ton.
On September 29, 2020 (Item No. 47), the Board approved Amendment No. 2 to the Agreement for the sale of solid waste landfill airspace to extend the term five years through December 31, 2025, exercising the second option to extend the Agreement, applying the annual increase to the Base Rate according to the Agreement, and increasing the Additional Rate for non-qualifying solid waste from $34.25 to $39.00 per ton.
On June 4, 2025, the City issued a letter of intent to exercise its third and last option to extend the Agreement for an additional five-year term.
Amendment No. 3 will extend the Agreement for an additional five years, from January 1, 2026 through December 31, 2030. The disposal rate will increase to $44.07 per ton effective January 1, 2026, aligning it with the WDA rate, plus $2. This adjustment ensures cities with WDAs are not charged more than out-of-county customers, while still providing the City a discounted rate compared to the County’s current gate rate of $49.49 per ton. The City’s rate will remain $2 above the WDA rate throughout the extension period, with no annual CPI adjustments. The WDA rate will only change if the County increases the gate rate, as it is capped at 85% of that rate.
This recommended action supports the goals and objects of the County and Chief Executive Officer by operating in a fiscally-responsible and business-like manner and working with other agencies and stakeholders by providing the City with landfill airspace for disposal of their solid waste, while generating revenue for SWMD.
SWMD has determined that allowing the continued acceptance of solid waste from the City will not adversely impact SWMD’s ability to handle the County’s current and projected future solid waste stream.
