Recommendation
Approve Agreement with the Baker Community Services District for operation of the Baker Medium Volume Transfer Processing Facility, and transportation of municipal solid waste collected to the Barstow Sanitary Landfill in the event the County is unable to provide service, in the amount not to exceed $348,254 for the period of July 1, 2023 to June 30, 2026, with an option to extend for one additional three-year period.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as the Department of Public Works - Solid Waste Management Division (SWMD) is financed by fee revenue. SWMD establishes fees that are charged to the public and other agencies for utilization of the County’s Waste Disposal System. Funding for year one of the agreement in the not-to-exceed amount of $116,084.56, and ongoing annual costs thereafter, will be included in SWMD’s 2023-24 recommended budget and in future recommended budgets.

The annual cost of up to $55,183 per year to haul municipal solid waste to the Barstow Sanitary Landfill is only in the event that the County is unable to perform this function. Historically, over the last 25 years since the Baker Community Services District (BCSD) has been operating the Baker Medium Volume Transfer Processing Facility (BMVTPF), the BCSD has not used this service. The total agreement cost is approximately $348,254 over the three-year term.
BACKGROUND INFORMATION
The recommended agreement with the BCSD will allow for the continued operation of a community collection center on property owned by the BCSD, as well as allow for the transportation of municipal solid waste from the BMVTPF to the Barstow Sanitary Landfill, if the County is unable to transport the waste (e.g. due to equipment breakdown).
The BCSD has been operating a community collection center on its property since June 1997, when the County’s then landfill operation contractor entered into an agreement with BCSD to construct and operate the collection center. From June 2001 to present, the County has contracted with the BCSD to continue to operate the community collection center.
The current Agreement No. 15-226 was originally approved by the Board of Supervisors (Board) on May 5, 2015 (Item No. 35) in the amount of $266,025 for a three-year term from July 1, 2015 to June 30, 2018. On May 1, 2018 (Item No. 33), the Board approved Amendment No. 1 to the agreement to increase the agreement by $177,349, from $266,025 to $443,374, and extend the term two years, from July 1, 2018 to June 30, 2020. On June 23, 2020 (Item No. 68), the Board approved Amendment No. 2 to the agreement, increasing the total agreement amount by $317,040, from $443,374 to $760,414, and exercising the last option to extend the term by three years, from July 1, 2020 to June 30, 2023.
SWMD requests Board approval of a new agreement to allow the BCSD to continue providing waste disposal services to County residents of the Baker area. The term of the agreement will be three years, from July 1, 2023 to June 30, 2026, with the option to extend the term for one additional three-year term.
