RECOMMENDATION(S)

Recommendation

1.                     Approve Restricted Grant Agreement, including non-standard terms, with Yuhaaviatam of San Manuel Nation, in the amount of $3,000,000, for the Pacific Village Campus Project in the City of San Bernardino, for the period of December 16, 2025, through December 16, 2030.

2.                     Authorize the Chief Executive Officer, as required by Yuhaaviatam of San Manuel Nation, to electronically execute and submit the Restricted Grant Agreement, and any subsequent non-substantive amendments, on behalf of the County, subject to review by County Counsel.

3.                     Direct the Director of the Community Development and Housing Department to transmit the Restricted Grant Agreement and all non-substantive amendments to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). This item seeks approval to accept $3,000,000 in San Manuel Cares grant (Grant) funding from the Yuhaaviatam of San Manuel Nation (Yuhaaviatam) awarded to San Bernardino County (County). There is no required local match.  The Community Development and Housing Department (CDH) will return to the Board at a later date to request any necessary budget adjustments.

 

BACKGROUND INFORMATION

CDH works to strengthen communities by facilitating access to affordable housing, enhancing neighborhood infrastructure, and supporting services that promote housing stability and self-sufficiency. The department implements a wide range of programs and capital projects aimed at addressing homelessness, housing insecurity, and community revitalization in alignment with Countywide Vision goals.

 

Pacific Village represents the County's most comprehensive approach to addressing homelessness through an integrated campus model. The multi-phased development, located on County-owned parcels on Pacific Street and Valaria Drive in the City of San Bernardino, provides a full continuum of care that addresses the root causes of housing instability while promoting long-term stability, healing, and dignity for vulnerable community members.

 

Phase I, completed in March 2021, established 28 interim housing units with on-site case management and comprehensive behavioral health support services. Phase II, currently under construction, will add 58 permanent supportive housing units, 32 recuperative care beds for individuals transitioning from hospital care, and a 16-bed residential substance use disorder treatment facility. Phase III, which is also currently under construction, will include an additional 16-bed substance use disorder residential treatment facility, bringing the total campus capacity to 86 housing units, 32 recuperative care beds, and 32 residential treatment beds for comprehensive addiction recovery services.

 

Due to unprecedented increases in construction and material costs since the inception of the Pacific Village project (Project), Phase II requires additional funding to complete key elements of the campus environment. These enhancements are vital to connecting programming spaces and transforming outdoor areas into functional and therapeutic community assets. Completing these features will ensure the campus fully supports resident wellness, recovery, and long-term stability through a cohesive and healing environment.

 

San Manuel Cares is the charitable giving program of Yuhaaviatam, designed to support organizations and initiatives that strengthen the Inland Empire and Indian Country. The program reflects Yuhaaviatam’s values of community investment, self-reliance, and cultural respect. San Manuel Cares grants have historically funded projects in the areas of education, public safety, health, economic development, and empowering resilient communities. The program accepts applications for funding between January and March of each year. For this particular Project, Yuhaaviatam extended a private invitation to the County to apply outside of its normal application cycle.

 

CDH, in collaboration with the Department of Behavioral Health and the Department of Aging and Adult Services, submitted a $3,000,000 funding request to Yuhaaviatam on August 29, 2025, to help complete Pacific Village Phase II. The grant-funded improvements align with the Project’s goals to foster community connection, promote resident wellness, and create a safe, inclusive environment. These enhancements will support trauma-informed programming, cultural integration, and sustained resident engagement. Progress and outcomes will be tracked through annual evaluations of housing stability, health and wellness improvements, and resident satisfaction.

 

These enhancements will transform the campus into a therapeutic environment that integrates culturally rooted treatment modalities reflecting tribal and holistic healing principles. The improvements will support trauma-informed programming, cultural integration, and sustained resident engagement. The campus will serve approximately 350 individuals annually across all program components and will establish Pacific Village as a regional model for comprehensive homelessness response that honors the dignity of every person while providing evidence-based interventions alongside traditional healing practices. Progress and outcomes will be tracked through annual evaluations of housing stability, healthcare access, treatment success, and community integration.

 

Acceptance of the Grant will help close the funding gap and ensure the campus fulfills its vision as a welcoming and therapeutic community environment. As part of the grant execution process, Yuhaaviatam will electronically transmit the final Restricted Grant Agreement (Agreement) to the County for execution by the Chief Executive Officer. Therefore, this item requests that the Board authorize the Chief Executive Officer to execute and submit the Agreement and subsequent non-substantive amendments to the Agreement on behalf of the County.

 

Yuhaaviatam requires the use of its own Agreement, which contains non-standard terms that differ from County policy as follows:

1.                     The Agreement does not allow the County to terminate for convenience.

                     The County standard term is that the County can terminate contracts for convenience with 30 days’ notice.

                     Potential Impact: There is no ability for the County to terminate for convenience.

2.                     The Agreement requires the County to indemnify, defend, and hold Yuhaaviatam harmless in any way connected to the terms and conditions of the Agreement, and waives all claims against Yuhaaviatam.

                     The County standard contract indemnity provision requires the contractor to indemnify, defend, and hold the County harmless from third-party claims arising out of the acts, errors, or omissions of any person.

                     Potential Impact: By agreeing to the indemnity provision, the County may be subject to increased cost, expenditures, and damages in the event of a third-party dispute.  

3.                     The Agreement will be governed by applicable tribal, federal and California law in that order.

                     The County standard contract is governed by applicable federal and California laws.

                     Potential Impact: County Counsel cannot advise on tribal law and to what extent it may be applicable.

 

CDH recommends approval of the Agreement, including the non-standard terms, as acceptance of the Grant will help the County complete Phase II of Pacific Village and realize its full potential as a regional model for comprehensive, culturally responsive care.
