RECOMMENDATION(S)

Recommendation

Approve Amendment No. 2 to the non-financial Joint Exercise of Powers Agreement No. 90-128, between San Bernardino County and the Cities of San Bernardino, Colton, and Loma Linda, for the Inland Valley Development Agency, updating the titles of officer positions and when officer elections will occur, with no other changes to provisions of the agreement.

BACKGROUND INFORMATION

On January 22, 1990 (Item No. 77), the Board of Supervisors (Board) approved the Joint Exercise of Powers Agreement No. 90-128 (Agreement), effective January 24, 1990, creating the Inland Valley Development Agency (Agency). The recommended amendment to the Agreement will modernize the titles of officer positions and revise officer elections to occur at the first regular meeting in an odd numbered calendar year, with no other changes to existing provisions of the Agreement.

 

The Agency is comprised of representatives from San Bernardino County and the Cities of San Bernardino, Colton, and Loma Linda. The purpose of the Agreement was to promote redevelopment of the Norton Air Force Base property and adjacent areas, following the base closure, in order to attract businesses, create jobs and improve the quality of life for county residents.

 

An amended Agreement No. 90-128 superseded and replaced the prior version of the Agreement, and was executed by the Chairman of the Board on the effective date of February 12, 1990 (Item Nos. 71). Amendment No. 1 to the Agreement was approved by the Board on April 13, 1992 (Item No. 36), which updated language regarding membership representation and voting rights for the Agency board. Two additional amendments to the Agreement were proposed and considered by the Board on April 23, 1996 (Item No. 33) and July 23, 1996 (Item No. 48). The first of these proposed amendments was rescinded by the Board on August 13, 1996 (Item No. 42), because all members of the Agency did not approve the amendment, so it was never fully executed or implemented. In addition, the proposed amendment presented to the Board in July of 1996 was never approved or fully executed by all members of the Agency, so was also never implemented. The recommended amendment is therefore Amendment No. 2 to the Agreement as no additional amendments have been executed or implemented since Amendment No. 1.

 

The recommended amendment has been approved by the Agency’s governing board and is in the process of being approved by the cities that are members of the Agency.
