Amendments to Contracts with the City of Colton for American Rescue Plan Act Funding

RECOMMENDATION(S)
Recommendation
Approve Amendment No. 1 to the following contracts with the City of Colton, for American Rescue Plan Act funding for eligible projects in accordance with the Board of Supervisors’ approved Coronavirus Local Fiscal Recovery Fund Spending Plan, to modify the deadlines for obligating project costs:
1. Contract No. 22-897 for the Colton Avenue Class I Bike Path and Trail Improvement Project, modifying the deadline for obligating project costs by 261 days, from June 30, 2024 to March 18, 2025, with no changes to the cost of $575,000 or term of July 1, 2022 through December 31, 2026.
2. Contract No. 22-898 for the Elizabeth Davis Park Improvements Project, modifying the deadline for obligating project costs by 548 days, from June 30, 2024 to December 30, 2025, with no changes to the cost of $1,890,594 or term of July 1, 2022 through December 31, 2026.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The County received a direct allocation of $423.5 million under the American Rescue Plan Act - Coronavirus Local Fiscal Recovery Fund (ARPA fund) to bolster the County’s response to COVID-19 pandemic and its economic impact. The Board of Supervisors (Board) approved an expenditure plan for the use of these funds, known as the County Local Fiscal Recovery Spending Plan (Spending Plan), on June 8, 2021 (Item No. 121), and amended the plan on August 24, 2021 (Item No. 21). The Fifth District Board Office has recommended executing Amendment No. 1 to Contract Nos. 22-897 and 22-898. This item will have no budgetary impact.
BACKGROUND INFORMATION
On March 11, 2021, the American Rescue Plan Act (ARPA) was signed into law and established the $350 billion Coronavirus State and Local Fiscal Recovery Fund to distribute resources to state and local governments throughout the nation.
The County established an ARPA Team who reviews all potential projects to determine eligibility for ARPA funding and if the project and use is in accordance with the Board approved Spending Plan. When projects are deemed eligible, the ARPA Team works with subrecipients to determine subrecipient compliance with ARPA guidelines and subsequently initiates the contract process.
On March 1, 2022 (Item No. 32), the Board authorized the Chief Executive Officer (CEO) to execute the Board-approved standard ARPA contract template with subrecipients and directed that ARPA contracts executed by the CEO be brought back to the Board for ratification within 30 days of contract execution. Monthly reporting has been provided to the Board detailing the status of ARPA contracts.
On September 27, 2022 (Item No. 26), the Board ratified the CEO’s exercise of the authority in executing Contract Nos. 22-897 and 22-898 on September 7, 2022, with the City of Colton (City). Contract Nos. 22-897 and 22-898 pertain to the Colton Avenue Class I Bike Path and Trail Improvement and the Elizabeth Davis Park Improvements Projects, with not-to-exceed amounts of $575,000 and $1,890,594, respectively, for the contract term of July 1, 2022 through December 31, 2026.
The Colton Avenue Class I Bike Path and Trail Improvement Project will upgrade the existing bike path along Colton Avenue especially for the landscaping, striping and signage. Signs and markings will be upgraded to the current Manual on Uniform Traffic Control Devices standard for bike routes. Upgrading bike lane striping and signs is anticipated to enhance the safety of the bike lane crossings on seven street intersections. The path had minimal landscaping and irrigation systems that deteriorated over the years and resulted in the deterioration of landscaping. Pedestrians and bicyclists heavily use the path as a safe route through the City for walking and cycling.
As part of the ARPA Team’s regularly scheduled subrecipient monitoring process, it was discovered that the City could not meet the initial obligation deadline due to unanticipated delays. These delays were caused primarily by staffing vacancies within the City’s Purchasing Division and challenges encountered by the City’s project vendor in obtaining the required insurance documents. Accordingly, the City is requesting an extension of the obligation deadline from June 30, 2024 to March 18, 2025 as all necessary procurement-related activities were not completed until that date. Extending the obligation deadline for this project will ensure compliance with Section 1.B of Contract 22-897 regarding the project cost obligation timeline. All other terms and conditions remain unchanged.
The Elizabeth Davis Park Improvements Project will include rehabilitation and improvements of the existing park amenities, which would include, but are not limited to: upgraded restrooms, new scoreboards, water fountains, trash receptacles, graffiti management, a dog park, parking lot, new park amenities (benches/tables/fixtures), surface improvement to tennis courts, Americans with Disabilities Act compliance, and security cameras and lighting.
As part of the ARPA Team’s regularly scheduled subrecipient monitoring process, it was discovered that the City could not meet the initial obligation deadline due to staffing vacancies within the City’s Community Services Department. These vacancies have since been resolved, and the project has now been identified as a departmental priority. Accordingly, the City is requesting an extension of the obligation deadline from June 30, 2024, to December 30, 2025. This extension will provide the City with sufficient time to complete all procurement-related activities for the project. All other terms and conditions remain unchanged.
