RECOMMENDATION(S)

Recommendation

Approve non-financial Memorandum of Understanding with the City of Needles for the Department of Public Health to provide environmental health services in the city’s incorporated areas, which shall be effective for a three-year term, commencing upon the execution by both parties.

FINANCIAL IMPACT

This item does not impact Discretionary General Funding (Net County Cost).  Environmental Health Services (EHS) will charge and collect fees from businesses and individuals in accordance with the County Fee Ordinance (which may include future amendments), and the County will recover the costs of the services provided under the recommended Memorandum of Understanding (MOU).  Adequate appropriation and revenue have been included in the Department of Public Health’s (DPH’s) 2020-21 budget and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

The recommended non-financial MOU will allow EHS to replace the current city agreement, which is out of date and requires renewal, in order to more clearly delineate the role of EHS in enforcing state law and County ordinances within the city, and to establish a fixed MOU term.  EHS provides environmental health services that include routine, follow-up, and special enforcement inspections of all multi-family dwelling units (three or more units), hotels and motels, massage clinics, and appropriate enforcement activities for substandard housing.  DPH has utilized a template MOU for these EHS services, approved by the Board of Supervisors (Board) on December 4, 2018 (Item No. 47), with the individual city MOUs executed by the DPH director.  The city of Needles has requested revisions to the template, requiring Board approval of a separate MOU. 

 

EHS is the Local Enforcement Agency for multiple mandated state laws and local ordinances.  This MOU is designed to cover activities that are not mandated by state law where EHS is the enforcement agency in the county unincorporated areas and has technical expertise.
