Recommendation
Approve Agreement with the California Highway Patrol (State Agreement No. 21R801000), in an amount not to exceed $614,880, for the County to reimburse costs associated with the California Highway Patrol’s participation in the San Bernardino County Auto Theft Task Force for the retroactive period of January 1, 2022 through December 31, 2026.

FINANCIAL IMPACT
This item will not result in the use of additional Discretionary General Funding (Net County Cost). The cost for California Highway Patrol’s (CHP) participation in the San Bernardino County Auto Theft Task Force (SANCATT), in an amount not to exceed $614,880, is included in the Auto Theft Task Force Special Revenue Fund’s 2022-23 budget (4430002385), which is financed by a portion of Department of Motor Vehicles (DMV) fees paid for vehicles registered in San Bernardino County (Vehicle Code Section 9250.14).
BACKGROUND INFORMATION
On May 2, 1995 (Item No. 33), the San Bernardino County Board of Supervisors (Board) adopted Resolution No. 95-104 pursuant to Vehicle Code Section 9250.14 specifically to fund a multi-jurisdictional vehicle theft task force to investigate and prosecute vehicle theft crimes.
The task force is comprised of personnel from the CHP, San Bernardino Police Department, Rialto Police Department, and Ontario Police Department, National Insurance Crime Bureau (NICB), California Department of Insurance, DMV, San Bernardino County District Attorney, and the San Bernardino County Sheriff/Coroner/Public Administrator who also administers the task force’s fund.
On May 21, 2018, the CHP requested to enter into a separate agreement with the County for reimbursement of costs associated with their participation in SANCATT for the period of January 1, 2018 through December 31, 2021. However, due to contract negotiations, the agreement was not presented to the Board for approval until August 25, 2020 (Item No. 64; Contract No. 20-688). On June 9, 2022, the Sheriff/Coroner/Public Administrator received the revised agreement (State Agreement No. 21R801000) from the CHP for the period of January 1, 2022, through December 31, 2026. The agreement is being submitted for Board approval at the first available meeting date after completion of the fiscal and legal review process.
Approval of this item will allow for SANCATT to reimburse CHP for up to $614,880 in overtime expenses incurred by their officers assigned to the task force during the period of the agreement. The agreement provides for cancellation by either party upon providing 30 days’ advance written notice. In the event of an emergency, the agreement may be canceled by either party without prior notice.
