RECOMMENDATION(S)
Recommendation
Acting as the governing body of Bloomington Recreation and Park District:
1. Approve Addendum No. 1, issued on September 19, 2024, Addendum No. 2, issued on October 2, 2024, and Addendum No. 3, issued on October 9, 2024, to the bid documents for the Ayala Park Splash Pad Project.
2. Award construction contract to Far West Contractors Corp., for the Ayala Park Splash Pad Project in the amount of $1,131,926.
3. Authorize a contingency fund of $113,192 for the Ayala Park Splash Pad Project.
4. Authorize the Director of the Department of Public Works to approve expenditures up to $113,192 for verified quantity overruns for this unit-priced construction contract.
5. Authorize the Director of the Department of Public Works to approve necessary changes or additions in the work being performed under the construction contract for a total amount, not-to-exceed, $69,096 of the $113,192 contingency fund, pursuant to Public Contract Code Section 20142.
6. Authorize the Director of the Department of Public Works to issue additional compensation for early completion, not-to-exceed $35,000.
7. Authorize the Director of the Department of Public Works to accept the work when 100% complete and execute and file the Notice of Completion.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost).
On December 5, 2023 (Item No. 76), the Board of Supervisors (Board) approved an allocation of $253,876 from the Fifth District’s Board of Supervisors Discretionary Fund - District Specific Priorities Program budget to the Bloomington Recreation and Park District (District) for the Ayala Park Splash Pad Project (Project) and $1,194,524 from the County’s American Rescue Plan Act (ARPA) Coronavirus Local Fiscal Recovery Fund (Recovery Fund) for eligible costs on the Project. These funding sources will be used to fund the proposed construction contract and contingencies costs of the Project. Sufficient appropriation and revenue are included in the District’s 2024-25 budget and will be included in future recommended budgets as needed.
BACKGROUND INFORMATION
The Department of Public Works - Special Districts (Department), through its Operations Division, directly manages, operates, and maintains the District, including Ayala Park.
The Project proposes the construction of a 40-foot diameter splash pad. The addition of the splash pad will be a fun, low-impact, and social activity for families to enjoy within the Bloomington area.
On September 10, 2024 (Item No. 67), the Board of Directors determined the Project was exempt under the California Environmental Quality Act and directed the Department to file and post said notice.
The Project aligns with the District and the Chief Executive Officer’s goals and objectives of ensuring development of a well-planned, balanced, and sustainable County by preserving and improving community facilities that provide for the recreational opportunities and experiences for the community.
PROCUREMENT
On September 10, 2024 (Item No. 67), the Board of Directors approved the Project’s plans and specifications and authorized the Director of the Department to advertise the Project for bids.
On September 12, 2024, the Department advertised the Project for bids through the County’s Electronic Procurement Network (e-Pro) (Bid No. SPD125-SPDAD-5617) and posted in the San Bernardino Sun newspaper in accordance with Public Contract Code Section 22037.
During the bidding process, the following addenda were issued:
• Addendum No. 1: Updated the Mandatory Pre-Bid Meeting Date.
• Addendum No. 2: Revised Licensing Requirements.
• Addendum No. 3: Revised the Bid Due Date.
On September 26, 2024, a total of nine contractors attended the Mandatory Pre-Bid Meeting. On October 15, 2024, the Department received the following bids:

The Department reviewed the bids received for the Project, and determined that the low bid was responsive, and recommends an award of the construction contract to Far West Contractors Corp., as the lowest responsible bidder. No appeal/protest letters have been received.
The lowest bidder was determined pursuant to Public Contract Code section 20103.8(b), the lowest total of the bid prices on the base contract and those additive or deductive items that were specifically identified in the bid solicitation, which included the lowest total of the total base bid plus Additive Bid No. 1 (Bench & Trash Receptacles). The Department has elected to move forward with awarding the Base Bid ($1,119,926) plus Additive Bid No. 1 ($12,000), for a total contract amount of $1,131,926.00.
Under an established formula based on the contract amount of $1,131,926, Public Contract Code Section 20142 allows the Board to authorize the Director of Public Works to order changes in the contract, including for unforeseen conditions or design shortfalls, should they become necessary in the future, for a total amount not to exceed $69,096 of the $113,192 contingency fund. Upon Board approval, construction is anticipated to commence in December 2024 and be completed by May 2025.
