RECOMMENDATION(S)

Recommendation

1.                     Acting as the governing body of San Bernardino County:

a.                     Adopt Resolution to accept Mountain View Boulevard from Division Drive east for approximately 0.24 miles, in the Big Bear City area, into the County Maintained Road System pursuant to Streets and Highways Code section 941.

b.                     Authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary budget adjustments, as detailed in the Financial Impact section (Four votes required).

2.                     Acting as the governing body of County Service Area 70 R-21 Mountain View:

a.                     Approve a $60,232 increase to the County Service Area 70 R-21 Mountain View Road Paving Project budget, from a total of $160,844 to $221,076.

b.                     Authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary budget adjustments, as indicated in the Financial Impact section, for the County Service Area 70 R-21 Mountain View Road Paving Project (Four votes required).

c.                     Award Construction Contract to Copp Contracting, Inc., in the amount of $166,823, for the County Services Area 70 R-21 Mountain View Road Paving Project.

d.                     Authorize a contingency fund of $16,683 for the County Service Area 70 R-21 Mountain View Road Paving Project.

e.                     Authorize the Director of the Department of Public Works to approve the expenditure of the contingency fund in the amount of $16,683 for verified quantity overruns for this unit- priced construction contract.

f.                     Authorize the Director of the Department of Public Works to order any necessary changes or additions in the work being performed under the construction contract with Copp Contracting, Inc., for a total amount not-to-exceed $16,683, pursuant to California Public Contract Code Section 20142.

g.                     Authorize the Director of the Department of Public Works to accept the work when 100% complete and execute and file the Notice of Completion.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).  County Service Area 70 R-21 Mountain View (District) is funded by special assessments on properties within the District. The County Service Area 70 R-21 Mountain View Road Paving Project (Project) includes $166,823 for the cost of the construction contract with Copp Contracting Inc., $16,683 for the Project’s contingency fund, and $37,570 for project management, design services, inspection services, and other Project related cost for a total estimated Project cost of $221,076.

 

The Project is being funded by a loan from the County Service Area Revolving Loan Fund (1380). The loan was approved by the Board of Supervisors (Board) on July 9, 2024 (Item No. 69), in the amount of $160,844, and an additional $60,232 in Gas Tax revenue will be allocated to fund the difference between the original loan and the total Project cost for the proposed new road now accepted into the County Maintained Road System (CMRS), and which includes project management, design services, and inspection services for the Project.

Sufficient appropriation will be included in future recommended budgets as necessary.

 

BACKGROUND INFORMATION

The District was established by the Board of Supervisors (Board) in 1987 for road maintenance and snow removal services for approximately 1,290 liner feet of roadway of Mountain View Boulevard in the Big Bear area.

 

On July 9, 2024 (Item No. 69), the Board approved funding of the Project and that the project would be presented to the Board in the future for official acceptance into the County Maintained Road System. The Project proposes to pulverize and repave approximately 1,290 linear feet of existing roadway along Mountain View Boulevard. The road improvement will be completed in accordance with County standards and inspected for compliance. The rehabilitation of the existing road will dramatically increase the health and longevity of the road.

 

Pursuant to Streets and Highways Code section 941, the Board may accept into the County Maintained Road System (CMRS) roads that are necessary to public convenience. Accepting this road into the CMRS will ensure the proper maintenance of this short section of roadway for public convenience.

On February 24, 2025, the County Administrative Office determined the Project was exempt under the California Environmental Quality Act and directed the Department of Public Works (Department) to file and post the Notice of Exemption.  The Assistant Executive Officer (AEO) also approved the Project’s plans and specifications and authorized the Director of the Department to advertise the Project for competitive bids.

This item aligns with the County and the Chief Executive Officer’s goals and objectives to provide for the safety, health, and wellbeing of County residents by ensuring the proper construction and maintenance of this section of roadway.

PROCUREMENT

On March 27, 2025, in accordance with Public Contract Code section 22037, the Department advertised the Project for bids through the County’s Electronic Procurement Network (ePro). On March 27, 2025, and April 3, 2025, the Department advertised the Project in the Big Bear Grizzly and the San Bernardino County Sun publications.

The Department received four bids, which significantly exceeded the Project budget and funding available.  On July 25, 2025 the AEO formally approved the rejection of all Project bids received on April 24, 2025, and found that rejection of the bids is in the best general interest of the County. Additionally, the AEO approved the revised specifications for the Project. The AEO authorized the Director of the Department of Public Works - Special Districts to re-advertise the revised Project.

On August 7, 2025, in accordance with Public Contract Code section 22037, the Department re-advertised the Project for bids through the County’s Electronic Procurement Network (ePro). On August 7, 2025 and August 14, 2025, the Department re-advertised the Project in the Big Bear Grizzly and the San Bernardino County Sun publications.

 

On August 21, 2025 a total of eight contractors attended the mandatory pre-bid site meeting.  On September 4, 2025, the following two bids were received:

The Department reviewed the bids received for the Project and determined all bids to be responsive.  The Department recommends that the Board award the construction contract to Copp Contracting, Inc., as the lowest responsive and responsible bidder.  No appeal/protest letters were received.

 

The Project will have a contingency fund of $16,683 to compensate the Contractor for verified quantity overruns, as well as changes in the contract under certain circumstances.  Under an established formula, Public Contract Code section 20142 allows the Board to authorize the Director of the Department to order changes in the contract for unforeseen conditions or design shortfalls, should they become necessary. Upon Board approval, construction is anticipated to commence and be completed in Spring 2026.
