RECOMMENDATION(S)

Recommendation

Approve Contract with Law Enforcement Medical Services, Inc. for the provision of medical evidence collection services in a not to exceed amount of $1,695,000, for the period of October 1, 2021 through September 30, 2024, with the option for two additional one-year extensions, or one additional two-year extension to the original term.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The annual cost of medical evidence collection services in the amount of $400,000 is included in the Sheriff/Coroner/Public Administrator’s (Sheriff) 2021-22 budget (4430001000) and $165,000 is included in the District Attorney’s 2021-22 budget (4500001000). Sufficient appropriation to fund the remaining contract amount will be included in future recommended budgets.

 

BACKGROUND INFORMATION

The Sheriff is responsible for collecting evidence during criminal investigations, and the District Attorney is responsible for the payment of evidence collection services provided to the California Highway Patrol within the geographical boundaries of the County and for payment of any necessary expert witness fees related to evidence collection. This contract includes services from qualified healthcare professionals to perform on-site blood withdrawal and sexual assault suspect and victim examinations at various locations throughout the County.

 

PROCUREMENT

On March 22, 2021, Request for Proposals (RFP) No. SHR121-ADMSR-4085 was approved and released through San Bernardino County’s electronic Procurement Network (ePro) for the provision of medical evidence collection services. The RFP was posted for twenty-eight (28) days and twenty-seven (27) registered vendors were contacted via e-mail notification. Law Enforcement Medical Services, Inc. was the only vendor to respond to the solicitation.

 

A committee consisting of one (1) representative from the Office of the District Attorney, three (3) representatives from the Sheriff’s Scientific Investigation Division, and one (1) representative from the Sheriff’s Bureau of Administration evaluated the proposal. The evaluation was based upon the proposer’s qualifications, financial statements, professional references, and proposed fees. As a result, Law Enforcement Medical Services, Inc. (LEMS) is recommended for contract award, having demonstrated the ability to meet the needs of the County. No protests or appeals were received.

 

The recommended contract term is three years, commencing October 1, 2021 through September 30, 2024, with the option to extend the term by two (2) additional one-year periods, or (1) one additional two-year period. Either party may terminate the agreement upon thirty (30) days written notice.
