Recommendation
Acting as the governing body of the San Bernardino County Flood Control District, approve Amendment No. 5 to non-financial Cooperative Agreement No. 00-1086 with the Chino Basin Water Conservation District, for water spreading in Grove Basin, to extend the term by five years, for a total term of October 24, 2000 through October 24, 2030.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as the San Bernardino County Flood Control District (District) is funded by property taxes, fees, and other local, state, and federal funding. The action to approve the Amendment has minimal financial impact, as it is only staff time to review and process. Sufficient appropriation is included in the District's 2025-26 budget and future recommended budgets.
BACKGROUND INFORMATION
The District completed the construction of the Grove Basin Drain on February 3, 2000, the Grove Avenue Basin on February 3, 2001, and the Riverside Storm Drain on June 29, 2004, as a means of minimizing any future flooding in the Chino Agricultural Preserve area and surrounding areas.
On October 24, 2000 (Item No. 11), the Board of Supervisors (Board) approved a five-year Cooperative Agreement No. 00-1086 (Agreement) with the Chino Basin Water Conservation District (CBWCD) for the construction of additional improvements to Grove Basin. The Agreement allows CBWCD a total of six five-year time extensions. CBWCD cannot unilaterally exercise the option to extend the Agreement, and time extensions can only proceed with the Board's approval.
Based on the Agreement, CBWCD contributed $384,000 towards the construction of improvements to help facilitate water conservation within Grove Basin. The improvements included a catwalk structure, outlet gates, a backup generator, a telemetry system, automated gate controls, an outlet equipment building, and other appurtenances.
The original term of the Agreement was from October 25, 2000, through October 24, 2005. In the 25 years since the Agreement was originally approved, the Board has approved four amendments which are summarized below:

CBWCD notified the District of its intent to exercise the fifth of six five-year options to extend the term of the Agreement through October 24, 2030.
The approval of this item would implement the fifth of six five-year options to extend the term of the Agreement with CBWCD to continue spreading water in Grove Basin. All other terms and conditions of the Agreement remain unchanged.
