Recommendation
Acting as the governing body of San Bernardino County Flood Control District:
1. Approve amendments for the following contracts, for on-call heavy equipment rental services, with no changes to the contract term of July 1, 2022, through June 30, 2027:
a. Amendment No. 1 to Agreement No. 22-618 with All-Pro Sweeping, Inc. increasing the contract amount by $2,500,000 from $2,500,000 to $5,000,000 and adding additional requirements in connection with Executive Order N-6-22 Russia Sanctions and Levine Act - Campaign Contribution Disclosure (formerly referred to as Senate Bill 1439).
b. Amendment No. 1 to Agreement No. 22-619 with Amer General Engineering, Inc. increasing the contract amount by $2,500,000 from $2,500,000 to $5,000,000 and adding additional requirements in connection with Executive Order N-6-22 Russia Sanctions and Levine Act - Campaign Contribution Disclosure (formerly referred to as Senate Bill 1439).
c. Amendment No. 3 to Agreement No. 22-628 with L. Curti Truck & Equipment, Inc. increasing the contract amount by $2,500,000 from $5,000,000 to $7,500,000.
2. Approve Amendment No. 1 for the following contracts, for on-call heavy equipment rental services with no changes to the contract term of August 22, 2023 through June 30, 2027:
a. Increase the contract amount to Agreement No. 23-908 with James Dickey, Inc. by $2,000,000 from $2,500,000 to $4,500,000.
b. Increase the contract amount to Agreement No. 23-914 with Weaver Grading, Inc. by $2,000,000 from $2,500,000 to $4,500,000.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The San Bernardino County Flood Control District (District) is funded by property tax revenue, fee revenue, and local, state, and federal funding. As these contracts are for on-call heavy equipment rental services, including routine maintenance, emergency services, and public projects not exceeding the amount specified in Public Contract Code Section 22032(a) (currently, $75,000), the specific projects have not yet been determined. Depending on the project, one of the above funding sources will be used to fund the cost of the contract.
BACKGROUND INFORMATION
On June 28, 2022 (Item No. 112), the Board of Supervisors (Board) approved contracts with 25 vendors to be on the on-call list for heavy equipment rental services, in the amount of $2,500,000 each, $500,000 annually, for the five-year period of July 1, 2022, through June 30, 2027. All-Pro Sweeping, Inc. (All-Pro Sweeping), Amer General Engineering, Inc. (Amer General), and L. Curti Truck & Equipment, Inc. (L. Curti) were awarded contracts during this session. On December 5, 2023 (Item No. 74) and November 19, 2024 (Item No. 65), the Board approved an increase to L. Curti (Agreement No. 22-628), increasing the contract amount by $2,500,000, from $2,500,000 to $5,000,000 with no change to the contract term of July 1, 2022, through June 30, 2027.
On August 22, 2023 (Item No. 90), the Board approved 14 contracts with vendors to be added to the on-call list for heavy equipment services, in the amount of $2,000,000 each, $500,000 annually, for the period of August 22, 2023, through June 30, 2027. James Dickey, Inc (James Dickey) and Weaver Grading, Inc. (Weaver Grading) were awarded contracts during this session.
On a monthly basis the District monitors contract expenditures and the District has determined that the contracts with All-Pro Sweeping (Agreement No. 22-618), Amer General (Agreement No. 22-619), L. Curti (Agreement No. 22-628), James Dickey (Agreement No. 23-908 ), and Weaver Grading (Agreement No. 23-914) are reaching the not-to-exceed amount as they frequently are the lowest bidders, and have been utilized to respond to various extreme weather events for operated equipment rentals. The proposed contract amendments will increase the total not-to-exceed amount as outlined in the recommendations, allowing the District to continue to receive and award bids. The contracts with All-Pro Sweeping and Amer General will also add additional requirements in connection with Executive Order N-6-22 Russia Sanctions and Levine Act - Campaign Contribution Disclosure (formerly referred to as Senate Bill 1439) contractor information reporting.
Having a list of contractors available for on-call heavy equipment rental services provides good value to the District, and aligns with the Districts and Chief Executive Officer’s goals and objectives to provide for the safety of District residents and to operate in a fiscally responsible and business-like manner.
