RECOMMENDATION(S)
Recommendation
1. Approve the specifications for the Third Street and Pacific Street Bus Stop Improvement Project in the unincorporated area of San Bernardino County, as signed and sealed by a registered civil engineer.
2. Authorize the Director of the Department of Public Works to advertise the Third Street and Pacific Street Bus Stop Improvement Project in the unincorporated area of San Bernardino County for formal bids.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Third Street and Pacific Street Bus Stop Improvement Project (Project) in the unincorporated area of San Bernardino County is funded by Transportation Development Act (TDA) Article 3 grant awards from San Bernardino County Transportation Authority (SBCTA) and Omnitrans in-kind contributions. The TDA grant amount for the Third Street portion of the Project is $69,300, with an Omnitrans contribution amount of $7,700. For the Pacific Street portion of the Project, the TDA grant amount is $90,000 and the Omnitrans contribution is $40,000. Sufficient appropriation and revenue are included in the Department of Public Works (Department) 2024-25 Road Operations budget (6650002000 H15252/H15248) and will be included in future recommended budgets as necessary.
BACKGROUND INFORMATION
The Project is located in the unincorporated area of San Bernardino at the following sites: (1) the northwest corner of East Third Street and Pedley Road; (2) southeast of Pacific Street and Glasgow Avenue; and (3) northeast of Pacific Street and Del Rosa Avenue. The scope of work includes sidewalk repair, curb and gutter, the construction of three concrete bus landing pads, and an American with Disabilities Act (ADA) compliant ramp at the Third Street and Pedley Road location. All right-of-way has been acquired for the Project.
On April 26, 2022 (Item No. 53), the Board of Supervisors (Board) adopted Resolution No. 2022-64, authorizing submittal of a claim for up to $69,300 in TDA Article 3 funds to SBCTA for bus stop improvements at Third Street and Pedley Road, upon certification of the completion of the improvements by the Director of the Department of Public Works.
On November 14, 2023 (Item No. 65), the Board approved Contract No. 23-1245, which granted funds from SBCTA in the amount of $90,000 under the 2023 Transportation Development Act Article 3 Call for Projects, for eastbound bus stop improvements on Pacific Street.
On March 21, 2024, the Department’s environmental staff reviewed this Project and determined that a categorical exemption in accordance with the California Environmental Quality Act (CEQA) Guidelines, Title 14 of the California Code of Regulations, Section 15301(c) Class 1 and Section 15302(c) Class 2 is appropriate. The Class 1 exemption allows for repair and maintenance activities on existing roads, sidewalks, gutters, and similar facilities that involve negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. The Class 2 exemption allows for replacement or reconstruction of existing utility systems and or facilities involving negligible or no expansion of capacity. The Notice of Exemption was filed and posted by the Clerk of the Board on October 9, 2024.
The Project’s specifications include an allowance in the amount of $25,000 for unforeseen differing site conditions and utility conflicts.
PROCUREMENT
The Project will be advertised to invite formal bids in accordance with Section 22037 of the California Public Contract Code. The Department anticipates returning to the Board for an award of the construction contract in Winter 2024/2025.
