Recommendation
Acting as the governing body of the San Bernardino County Fire Protection District (SBCFPD), approve Memorandum of Understanding with the County of San Bernardino, through the Sheriff’s Department, to provide SBCFPD’s Arson Investigation Unit and the Fire Marshal/Deputy Fire Warden with access to the California Law Enforcement Telecommunications System, Central Name Index and the Sheriff’s criminal databases for the period of July 14, 2020 through June 30, 2022 at a cost of $726 for 2020-21 and adjusted thereafter.

FINANCIAL IMPACT
The recommended Memorandum of Understanding (MOU) will not result in the use of additional Discretionary General Funding (Net County Cost). The Sheriff/Coroner/Public Administrator (Sheriff) will charge SBCFPD for access to the Sheriff’s automated systems. The charge for 2020-21 is $726. This amount will be adjusted for year two as fees are reviewed annually to ensure full cost recovery of providing services.
BACKGROUND INFORMATION
The Sheriff’s Department, as the State designated “County Control Agency” (California Government Code section 15163), provides access to the California Law Enforcement Telecommunications System (CLETS) by local, state and federal agencies and County departments for use by law enforcement personnel. In 2005, the Sheriff installed a new switching center. Law enforcement agencies are required to be connected to the County’s Wide Area Network (WAN) in order to access CLETS through the Sheriff’s switching center. With WAN connectivity, law enforcement agencies may also have access to the Sheriff’s automated systems. An approved MOU for access to these systems is necessary to ensure proper liability coverage, cost recovery and operating procedures between the parties.
The Fire Marshal for SBCFPD provides arson investigation within SBCFPD’s jurisdiction. Gaining access to the CLETS system will allow the Fire Marshal’s Arson Investigation unit to review criminal offender information related to arson investigations. Access will be limited to the Arson Investigation Unit and the Fire Marshal/Deputy Fire Warden. SBCFPD will develop Operations Directives concerning use and access guidelines for department personnel.
On May 23, 2017 (Item No. 130), the County of San Bernardino Board of Supervisors (Board) approved the MOU template for providing access to the Sheriff Department’s automated systems. The Board also authorized the Sheriff and other designated staff to approve/execute individual MOU’s with local, state and federal agencies and County departments for a period through June 30, 2022.
