Recommendation

1.                     Approve Amendment No. 2 to Contract No. 25-101 with Dalke & Sons Construction, Inc., for the Sheriff SID Orange and Blue Labs Remodel Project in San Bernardino for additional work required due to unforeseen conditions, increasing the contract amount by $247,572.05, from $6,893,308.49 to $7,140,880.54, and extending the construction completion date by 89 days, from April 30, 2026 to July 28, 2026 (Four votes required).

2.                     Approve Change Order No. 2 to Contract No. 25-101 with Dalke & Sons Construction, Inc. for owner-directed field changes and responses to Requests for Information, increasing the total amount by $89,534.43, from $7,140,880.54 to $7,230,414.97, with no change to the construction completion date of July 28, 2026 (Four votes required).

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The cumulative increase of $337,106.48 associated with the amendment and change order will be fully funded within the existing budget of the Sheriff/Coroner/Public Administrator’s (Sheriff) Scientific Investigations Division (SID) Orange and Blue Labs Remodel Project (Project) (WBSE 10.10.1493). The Project has a total approved budget of $8,561,120, which is funded with Proposition 172 reserve funds, as authorized by the Board of Supervisors (Board) on June 10, 2025, as part of the 2025-26 Capital Improvement Program budget (Item No. 136).

 

BACKGROUND INFORMATION

The Project addresses long-standing space constraints at the Sheriff SID Orange and Blue laboratories, which serves all San Bernardino County law enforcement agencies. Accredited since 1995, the lab employs over 100 staff however operates with only 22,000 square feet which is far below the American Society of Crime Laboratory Directors and the American National Standards Institute National Accreditation Board guideline of 1,000 square feet per analyst. Originally built in the 1970s and expanded over time with trailers and an annex, the facility remains insufficient to meet the growing demand for forensic services, particularly in the Forensic Biology Unit. The Project will reconfigure the Chemistry and Trace Analysis laboratories to accommodate additional staff and upgrade flooring, utilities, and heating ventilation and air conditioning systems. The Project includes Americans with Disabilities Act (ADA) and California Building Code compliance improvements, restroom and shower remodels, office and lab space redesign, and site upgrades to provide an ADA compliant path of travel.

On September 24, 2024 (Item No. 45), the Board authorized the Project and Facilities Management Department (PFMD) to solicit competitive bids for the Project via Request for Proposals No. ANE223-ANE2C-5624.  On February 11, 2025 (Item No. 26), the Board awarded Construction Contract No. 25-101 to Dalke & Sons Construction, Inc. (Contractor) in the amount of $6,692,000, with a construction contract completion date of 365 days from the date PFMD issued the Contractor a Notice to Proceed.

Initially, the Sheriff planned to relocate its staff to its Annex building during construction of the Project. However, in January 2025, the Sheriff determined the move was not feasible and requested the construction of temporary lab space within existing offices to relocate staff during the construction of the Project. The temporary lab space was completed on June 10, 2025, by a Job Order Contractor. Construction of the Project began on June 11, 2025.

On  December 16, 2025 (Item No. 67), the Board approved Amendment No. 1 (A1) to Contract No. 25-101, in the amount of $179,318.37, increasing the total contract amount to $6,871,318.37, to compensate the Contractor for additional work required to address unforeseen conditions discovered after construction began, including slab demolition, installation of new curbs with grading, wall repairs, electrical relocation, temporary water heaters, moisture mitigation, and added roof insulation. A1 also extended the contract time by 58 calendar days, from 365 to 423 days, to complete the additional scope of work. The Board simultaneously approved Change Order No. 1, in the amount of $21,990.12, increasing the total contract amount to $6,893,308.49, to compensate the Contractor for San Bernardino County Fire Protection District (SBCFPD) permit fees and processing, as well as labor, material and equipment needed to build a box beam/structural frame to mount exhaust fans, reinforce an existing soffit, install two new ceiling register covers, cap off and relocate a water heater, provide new door hardware, repaint the hallway walls and investigate gate power issues.

 

Approval of Amendment No. 2 (A2) to Contract No. 25-101, in the amount of $247,572.05, will compensate the contractor for additional work required to address unforeseen conditions. The additional scope includes replacement of a laboratory waste glass pipe with a Schedule 80 polypropylene plumbing system; concrete patching; water mitigation due to unforeseen weather conditions; and remediation of pre-existing building cracks, including import of gravel and use of soil drying agents to achieve required compaction. The amendment also includes epoxy infill at concrete masonry unit walls and installation of five new 18-inch dry barrel pendent fire sprinkler heads, as required by SBCFPD. A2 also extends the contract completion period by 89 days, from 423 to 512 days, to allow for completion of the additional work.

 

Approval of Change Order No. 2 (CO2) to Contract No. 25-101, in the amount of $89,534.43, addresses owner-directed field changes and responses to Requests for Information. The additional work includes reimbursement of permit fees paid to SBCFPD as part of the deferred submittal process; investigation of electrical load and installation of two mini-split air conditioning systems; rerouting of conduit to resolve conflicts with mechanical curbs resulting from inaccurate as-built drawings, and modifications to door height due to differing site conditions.

The unanticipated additional costs in A2 and CO2 are related to events that took place after the competitive bid process that resulted in the original contract award to the Contractor. Therefore, no additional procurement activities are required.

Public Contract Code section 20136 requires all change orders and amendments to construction contracts to have a four-vote approval by the Board.
