Recommendation
Approve Development Mitigation Cooperative Agreement with the City of Rialto, wherein San Bernardino County agrees to reimburse the City of Rialto up to $154,836 to fund its share of the development mitigation fair-share requirements for the Plans, Specifications, and Estimate and Right-of-Way Phases of the Interstate 10/Riverside Avenue Interchange Phase 2 Project in the Rialto Area, effective upon execution by both parties and terminating upon final fair-share payment by San Bernardino County, or on March 31, 2040, whichever occurs first.

FINANCIAL IMPACT
Approval of the recommendation will not result in the use of Discretionary General Funding (Net County Cost). The Interstate 10/Riverside Avenue Interchange Phase 2 project (Project) in the Rialto area is included in the San Bernardino County Transportation Authority (SBCTA) Measure I 2010-2040 Nexus Study (Nexus Study). In accordance with the Nexus Study, which determines each party’s fair-share contribution of development impact fees and funding, the costs associated with the Project’s Plans, Specifications and Estimate (PS&E) and Right-of-Way (ROW) phases will be shared between SBCTA, and is split at the Public Share of 72.6% and the Local Share of 27.4%. The Local Share (27.4%) is further distributed between the County at 7.9%, City of Rialto (Rialto) at 65.9%, and the City of Colton (Colton) at 26.2%. The estimated total cost of $7,153,107 for the PS&E and ROW phases of the Project will be shared as follows:

The County agrees to reimburse Rialto up to $154,836 for its share of costs, as sufficient DIF are collected through its Regional Transportation Development Mitigation Plan for the San Bernardino Freeway Interchange-Rialto Sphere of Influence. Sufficient appropriation and revenue are included in the Department of Public Works (Department) 2024-25 Road Operations Budget (6650002109 M00019).
BACKGROUND INFORMATION
SBCTA is the administrator of the geographic county’s Congestion Management Program. As administrator, SBCTA must prepare a Congestion Management Plan (CMP). The CMP defines a network of state highways and arterial roads, traffic flow standards and related procedures, a process for mitigation of the impacts of new development on the transportation system, and technical data to justify the approach to congestion management.
The CMP identifies the Nexus Study Network, which represents regional roadways in the urbanized areas of the county. Roadway improvement projects must be located on this network for their costs to be eligible to receive Measure I 2010-2040 Valley Freeway Interchange program funds from SBCTA. The Nexus Study also identifies the fair-share contributions from new development for regional transportation improvements. Development fair-share contributions are fees collected from developers that are applied to Nexus Study projects to mitigate the increased traffic resulting from the development. Local shares of project cost percentages are determined by the proportional share of expected traffic increase that will result from development within each jurisdiction.
The Project is identified in the Nexus Study as eligible to receive funding under the Measure I 2010-2040 San Bernardino Valley Freeway Interchange Program, as part of the Public Share. The Nexus Study also requires a Local Share, which is funded by a local agency’s DIF collected for the specific subarea or sphere of influence. The DIF are collected from developers to mitigate the transportation impact attributed to new development through the construction of projects that reduce traffic congestion.
The Project will widen the existing Riverside Avenue bridge structure over the Union Pacific Railroad (UPRR) tracks south of Interstate 10 to Slover Avenue to match the lane configuration constructed as part of the Interstate 10/Riverside Avenue Interchange Project - Phase I, add two lanes in the northbound direction to connect to the existing two left-turn lanes on the overcrossing, and provide for sidewalks. In 2011, Rialto, along with the State of California Department of Transportation, completed Phase I of the project, which widened a portion of the bridge over the UPRR tracks, widened the on and off ramps, improved drainage, and updated surrounding aesthetics.
In accordance with the Development Mitigation Cooperative Agreement (Agreement), Rialto will serve as the lead agency for the Project’s PS&E and ROW phases. The Agreement shall terminate upon final DIF payment by the County or the expiration of the Measure I 2010-2040 Program on March 31, 2040, whichever occurs first. Rialto completed the Project Approval and Environmental Document phase during the Project’s Phase I. Rialto is currently seeking funding sources for the construction phase of the Project. Once funding sources for construction are secured, an amendment to the Agreement will be presented to the parties’ respective Boards for consideration and approval. Rialto approved this Agreement on June 11, 2024.
