Recommendation

Approve Amendment No. 1 to Revenue Agreement No. 21-519 with Mammoth Mountain Ski Area, LLC, extending the term five years for the total contract term of July 1, 2021 to June 30, 2031, with the option to extend up to five additional years and generating gross revenue in the amount of $96,885, for the disposal of biosolids at the Barstow Sanitary Landfill.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as the Department of Public Works - Solid Waste Management Division (SWMD) is funded by fee revenue. SWMD establishes fees that are charged to the public and other agencies for utilization of the County’s Waste Disposal System. It is anticipated that Mammoth Mountain Ski Area, LLC (MMSA) will dispose of up to 150 tons of biosolids per year. MMSA will be charged the published Gate Rate, plus a Special Handling fee, in accordance with the County’s Fee Ordinance, plus 20% of the total gate rate and Special Handling Fee for this import. This Agreement could generate revenue of up to $96,885 for SWMD during the five-year extension period. However, the annual tonnage delivered by MMSA may be less than anticipated, and the total revenue will be adjusted accordingly.

 

BACKGROUND INFORMATION

This Amendment will allow SWMD to continue to dispose of dried biosolid waste from MMSA’s percolation ponds in Mammoth Lakes, California at the Barstow Sanitary Landfill.

 

The septic waste from the percolation ponds at MMSA are routinely dried to greater than 50% solids and are sampled in accordance with the Waste Acceptance Plan (Plan) for the Barstow Sanitary Landfill to ensure the analytical results indicate the material is in compliance with the Plan and are suitable for disposal at a solid waste landfill facility. All biosolid materials must be disposed of in a timely, biosecure, and environmentally responsible manner.

 

On June 22, 2021 (Item No. 64), the Board of Supervisors approved Agreement No. 21-519 (Agreement) with MMSA to allow the disposal of biosolids at the Barstow Sanitary Landfill. This five-year Agreement was effective July 1, 2021 and expires June 30, 2026. The Agreement is in accordance with County Code section 33.08151 of Title 3, Division 3, Chapter 8, Article 9: Out-of-County Refuse, which states that refuse haulers or generators may discharge solid waste generated in counties other than San Bernardino County at facilities within the County Solid Waste Disposal System, if and only to the extent provided for in a written contract entered into with the County allowing for such disposal, on payment of all fees applicable to the discharge of such solid waste, as specified in section 16.0222 of the San Bernardino County Code. Additionally, a premium of 20% of the total gate rate and Special Handling Fee was added since this is imported waste coming from outside the County.

 

The recommended action supports the goal and objectives of operating in a fiscally-responsible and business-like manner by assisting MMSA with the burial of the dried biosolids at a permitted landfill in an environmentally responsible manner.
