Recommendation
Acting as the governing body of the San Bernardino County Fire Protection District:
1. Approve Amendment No. 4 to Agreement No. 18-397 with the City of Adelanto, increasing the annual amount by $44,155 (from $5,238,184 to $5,282,339) beginning in 2021-22 to compensate the San Bernardino County Fire Protection District for the use of fire apparatus associated with the provision of fire protection and emergency medical services to the City of Adelanto, with all other terms of the contract remaining in effect through June 30, 2028.
2. Approve Amendment No. 5 to Agreement No. 18-397 with the City of Adelanto, increasing the annual contract amount by $247,774 (from $5,282,339 to $5,530,113) beginning in 2021-22 to compensate San Bernardino County Fire Protection District for its costs of providing fire protection and emergency medical services to the City of Adelanto, with all other terms of the contract remaining in effect through June 30, 2028.

FINANCIAL IMPACT
Approval of these amendments will not result in the use of additional Discretionary General Funding (Net County Cost) as the City of Adelanto (City) is compensating San Bernardino County Fire Protection District (SBCFPD) for the cost of providing service in accordance with the terms of Agreement No. 18-397. The total increase in annual compensation to SBCFPD from these two amendments is $291,929. This amount includes additional compensation for increased salary/benefit expenses resulting from negotiated MOUs with the labor unions and a new charge to the City for use of certain SBCFPD fire apparatus.
Revenue and appropriation for this agreement, including the amendments, are included in SBCFPD’s 2021-22 budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
On June 26, 2018 (Item No. 79), the Board of Directors (Board) approved Agreement No. 18-397 (Agreement) allowing SBCFPD to provide fire protection and emergency medical services to the City for a term of ten years from July 1, 2018 through June 30, 2028. The compensation amount to SBCFPD for providing these services may be adjusted annually based on various factors and in accordance with Section 3.B of the Agreement.
To date, the Agreement has been amended three times. The Board approved the most recent of these amendments (Amendment No. 3) on July 14, 2020 (Item No. 55), which increased SBCFPD’s annual compensation amount to $5,238,184 for 2020-21.
Approval of Amendment No. 4 will increase the Agreement’s annual compensation amount by $44,155 (from $5,238,184 to $5,282,339) as the City agrees to reimburse SBCFPD for costs associated with the use of SBCFPD fire apparatus described in Exhibit 4 of Amendment No. 4. This amendment allows the City to fund the cost of SBCFPD’s fire apparatus over the duration of the Agreement, rather than the alternative of the City paying up front for the cost to replace its current City-owned fire apparatus.
In accordance with Amendment No. 4, SBCFPD will be responsible for all maintenance and repair costs of the fire apparatus. Should the fire apparatus be deemed no longer operational for a period of 30 days, SBCFPD agrees to provide replacement fire apparatus of similar specifications and use.
Approval of Amendment No. 5 will increase the Agreement’s annual compensation amount by $247,774 (from $5,282,339 to $5,530,113) for SBCFPD’s additional costs of providing service to the City. The additional costs primarily represent increased salary and benefit expenses resulting from negotiated MOUs with the labor unions.
Both Amendment No. 4 and Amendment No. 5 shall take effect on July 1, 2021. All other terms of the Agreement shall remain the same.
