RECOMMENDATION(S)

Recommendation

1.                     Acting as the governing body of San Bernardino County authorize the Auditor-Controller/Treasurer/Tax Collector to post budget adjustments, as detailed in the Financial Impact section, for the County Service Area 120 North Etiwanda Preserve Bathroom Addition Project (Four votes required).

2.                     Acting as the governing body of County Service Area 120 North Etiwanda Preserve:

a.                     Approve an increase to the project cost in the amount of $313,856, from $306,000 to $619,856, for additional project elements required that were not included in the original estimate, for the County Service Area 120 North Etiwanda Preserve Bathroom Addition Project.

b.                     Approve Addendum No. 1, issued on December 15, 2025, to the bid documents for the County Service Area 120 North Etiwanda Preserve Bathroom Addition Project.

c.                     Award Construction Contract to Oppenheimer National, in the amount of $459,680 for a term of 180 calendar days after issuance of the Notice to Proceed for the County Service Area 120 North Etiwanda Preserve Bathroom Addition Project.

d.                     Authorize a contingency fund of $45,968 for the County Service Area 120 North Etiwanda Preserve Bathroom Addition Project.

e.                     Authorize the Director of the Department of Public Works to approve expenditures up to $45,968 for verified quantity overruns for this unit-priced construction contract.

f.                     Authorize the Director of the Department of Public Works to order any necessary changes or additions in the work being performed under the construction contract with Oppenheimer National, for a total amount not to exceed $35,484 of the $45,968 contingency fund, pursuant to Public Contract Code Section 20142.

g.                     Authorize the Director of the Department of Public Works to accept the work when 100% complete, and to execute and file the Notice of Completion.

h.                     Authorize the Auditor-Controller/Treasurer/Tax Collector to post budget adjustments, as detailed in the Financial Impact section, for the County Service Area 120 North Etiwanda Preserve Bathroom Addition Project (Four votes required).

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost).

 

An additional $369,856 use of the Etiwanda Preserve General Fund Reserve is being requested for the County Service Area (CSA) 120 - North Etiwanda Preserve (District) Bathroom Addition (Project). Of this amount, $313,856 will increase the project budget to address additional project-related costs, and $56,000 will reimburse the District for its prior use of Available Reserves approved in the 2024-25 Budget. This reimbursement will restore District’s Available Reserves to support the ongoing operation and maintenance of the Preserve. Sufficient appropriation for the Project will be included in the District’s future recommended budgets as needed.

BACKGROUND INFORMATION

The North Etiwanda Preserve (Preserve) was established in 1998 as a habitat conservation area located in the northernmost portion of the City of Rancho Cucamonga (City). The Preserve protects the rare Riversidean Alluvial Fan Sage Scrub plant community and provides valuable habitat for endangered and threatened species displaced or impacted during construction of the Interstate 210 Freeway, including the Coastal California Gnatcatcher. The surrounding communities regularly use the Preserve’s open trails for hiking, nature walks, and opportunities to experience a natural setting within proximity to the City.

 

On October 25, 2022 (Item No. 38), the Board of Supervisors (Board) approved a $1,000,000 allocation from the Second District’s Board Discretionary Fund - District Specific Priorities Program to establish the Etiwanda Preserve General Fund Reserve (Reserve) for future improvements and maintenance associated with the Preserve.

 

On June 11, 2024 (Item No. 113), the Board approved the Project in the amount of $306,000 as part of the 2024-25 Recommended Budget. Project funding included a $250,000 use of the Reserve and $56,000 from the District’s Available Reserves. The Project scope includes installation of a single prefabricated restroom, associated civil and utility improvements, and Americans with Disabilities Act-compliant parking stalls near the main trailhead parking lot.

 

On November 5, 2025, pursuant to County Policy No. 11-15, the Assistant Executive Officer (AEO) determined the Project was exempt under the California Environmental Quality Act and directed the Department of Public Works (DPW) to file and post the Notice of Exemption.  The AEO also approved the Project’s plans and specifications and authorized the Director of the DPW to advertise the Project for competitive bids.

 

Following completion of design and advertisement for competitive bids, bids received exceeded the original project budget of $306,000. The original budget was developed in 2024 during preparation of the Project Initiation Form (PIF) and was based on preliminary scope assumptions prior to completion of design and agency coordination. The project was not advertised for construction until November 2025, resulting in more than one year between the original planning-level estimate and the bid environment. During design and coordination with the City of Rancho Cucamonga and Flood Control, additional project elements were required, including a raised concrete pad, parking, and ADA improvements that were not included in the original estimate.

 

Bid results confirmed that the procurement of the prefabricated restroom facility and associated site improvements represent the primary cost driver. Across all nine bids received, this portion of the work ranged between $220,000 and $290,000, representing roughly 70% to 90% of the original PIF approved funding. Based on these competitive bid results, additional funding is required to award the construction contract in the amount of $459,680 to the lowest responsive and responsible bidder to complete the Project.

 

The Project includes a contingency fund in the amount of $45,968 to compensate the contractor for verified quantity overruns and contract changes under certain circumstances. Pursuant to Public Contract Code Section 20142, the Board may authorize the Director of DPW to order changes in the work for unforeseen conditions or design shortfalls in an amount not to exceed $35,484 of the contingency fund.

 

Upon Board approval, construction is anticipated to commence in Spring 2026, with completion expected by Summer 2026.

 

PROCUREMENT

On November 18, 2025, in accordance with Public Contract Code section 22037, DPW advertised the Project for bids through the County’s Electronic Procurement Network (ePro). The Project was also advertised on November 18, 2025, and November 25, 2025, in the Inland Valley and The Press-Enterprise newspapers.

 

During the bidding process, Addendum No. 1 issued to provided responses to questions received during the bidding process and extended the bid opening date from December 19, 2025, to January 7, 2026.

 

On December 4, 2025, a total of 24 contractors attended the mandatory pre-bid meeting. On January 7, 2026, DPW received a total of nine bids.

DPW reviewed the bids received and determined that Oppenheimer National was the lowest and responsive contractor.  DPW recommends award of the construction contract to Oppenheimer National in the amount of $459,680, pursuant to Public Contract Code section 20103.8(b).

 

No protest or appeal letters were received during the bid review period.
