RECOMMENDATION(S)
Recommendation
Acting as the Governing Body of the County Service Area 64 Spring Valley Lake:
1. Find that the acquisition of two easements, totaling approximately 4,267 square feet of real property (portions of Assessor’s Parcel Numbers 0482-261-04-0000 and 0482-262-06-0000), located in the City of Victorville is an exempt project under the California Environmental Quality Act Guidelines Class 11 Section 15311 (Accessory Structures) and Section 15061(b)(3) Common Sense Exemption.
2. Approve Appraisal Nos. 24-24 and 24-25, copies of which are on file with the Real Estate Services Department.
3. Authorize the acquisition of two Grants of Easement from two property owners over portions of certain real properties, totaling approximately 4,267 square feet, for the Spring Valley Lake Archway Renovation Project in the City of Victorville for maintenance purposes, at a total cost not to exceed $15,398, which includes the just compensation and an approximate 10% contingency amount.
4. Approve the form of an Acquisition Agreement to acquire two Grants of Easement, for maintenance purposes, from two property owners for the Spring Valley Lake Archway Renovation Project in the City of Victorville.
5. Authorize the Director of the Real Estate Services Department to complete and execute two Acquisition Agreements in substantial conformance with the approved form of Acquisition Agreement to acquire two Grants of Easement, for maintenance purposes, from two property owners over portions of certain real properties, totaling approximately 4,267 square feet, for the Spring Valley Lake Archway Renovation Project in the City of Victorville, at a total cost not to exceed $15,398, which includes the just compensation and an approximate 10% contingency amount.
6. Authorize the Director of the Real Estate Services Department to execute an acceptance certificate to attach to the Grants of Easement and any other non-substantive documents necessary to complete this transaction, subject to County Counsel review.
7. Direct the Real Estate Services Department to file the Notice of Exemption in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The two Grants of Easement (Easements) for the Spring Valley Lake Archway Renovation Project (Project) will be funded with County Service Area 64 Spring Valley Lake (CSA 64) water and sanitation fees charged to customers based on usage. The total cost to acquire the Easements is $13,998 plus an approximate 10% contingency for an aggregate cost not to exceed $15,398. Sufficient appropriation and revenue are included in CSA 64's 2024-25 Capital Improvement Program budget.
BACKGROUND INFORMATION
The Project involves renovations to the entry and gateway monument for the archway located on Spring Valley Parkway, north of Bear Valley Road in the City of Victorville. CSA 64 requires the Easements, totaling approximately 4,267 square feet, from two property owners to complete the Project and provide ongoing maintenance of the archway. One Easement, for approximately 2,139 square feet, is located at Outer Bear Valley Road in Victorville [Assessor’s Parcel Number (APN) 0482-261-04-0000]. The second Easement, for approximately 2,128 square feet, is located at Eastside Spring Valley Parkway in Victorville (APN 0482-262-06-0000). CSA 64 has requested assistance from the Real Estate Services Department (RESD) in the valuation and acquisition of the Easements required for the Project.

RESD reviewed the necessary property rights for the Project with CSA 64 and initiated the valuation of the Easements under the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended, Government Code section 7260 et seq., Government Code Section 25212(b), corresponding regulations, and County Policy No. 12-20, for the acquisition of property rights for a public project.
Appraisal Nos. 24-24 and 24-25, copies of which are on file with RESD, were professionally prepared and approved by qualified RESD staff. The appraisals establish the amounts of just compensation to be paid to the two property owners for the Easements necessary to complete the Project. RESD recommends that the appraisals be approved and that written offers be made to the impacted property owners.
Additionally, this item will authorize the Director of RESD to execute other documents necessary to complete this transaction, subject to County Counsel review as applicable. The Director of RESD will not be authorized to execute any documents that would substantially modify the transaction, which is the subject of these recommendations.
The acquisition by CSA 64 of the Easements was reviewed pursuant to the California Environmental Quality Act (CEQA) and determined to be categorically exempt from further environmental review in accordance with CEQA Guidelines Section 15311 Class 11 (Accessory Structures) because renovations for which the Easements are being acquired are relatively minor alterations of an existing public institution facility/structure, and Section 15061 (b)(3) Common Sense Exemption because it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment. RESD will have fulfilled its obligations under CEQA for this acquisition with the posting of the Notice of Exemption.
PROCUREMENT
RESD can make offers and acquire the necessary Easements in conformance with all applicable provisions of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended, Government Code section 7260 et seq., Government Code Section 25212(b), corresponding regulations, and County Policy No. 12-20.
