Recommendation
Approve Amendment No. 3 to Contract No. 18-904, including a non-standard term, with The Counseling Team International for the provision of psychological services, increasing the contract amount by $360,000, from $3,080,000 to a new total amount not to exceed $3,440,000, and extending the term by six months, for a new contract period of January 1, 2019, through June 30, 2024.

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). Sufficient appropriation and revenue are included in the 2023-24 budgets for the departments listed below. The anticipated costs for the six-month extension are as follows:

BACKGROUND INFORMATION
The Counseling Team International (TCTI) provides psychological services to the District Attorney, San Bernardino County Fire Protection District, Human Resources, Probation and Sheriff/Coroner/Public Administrator (Sheriff) (collectively Departments) related to pre-employment screening, critical incident stress debriefing, and 24-hour trauma intervention. In addition, TCTI provides counseling for employees and eligible dependents of the Sheriff, including training and support to the Peer Support Team and supervisors; hostage/barricade negotiation incident support; fitness for duty examinations; and training for the Sheriff’s Training Academy. The increase in funding will pay for the six months of services provided under the contract.
On December 18, 2018 (Item No. 75), resulting from a competitive process, the Board of Supervisors (Board) approved Contract No. 18-904 with TCTI in an amount not to exceed $1,942,800 to be used by Departments, for the period of January 1, 2019 through December 31, 2021, with the option to extend the term for two additional one-year periods.
On January 11, 2022 (Item No. 36), the Board approved Amendment No. 1 to Contract No. 18-904 with TCTI, increasing the contract amount by $563,600, for a new total amount not to exceed $2,506,400, and exercising the first of two options to extend the contract by one-year, for a new total contract term of January 1, 2019 through December 31, 2022.
On November 15, 2022 (Item No. 88), the Board approved Amendment No. 2 to Contract No. 18-904 with TCTI, increasing the contract amount by $573,600, for a new total amount not to exceed $3,080,000 and exercising the final option to extend the contract by one-year, for a new total contract term of January 1, 2019, through December 31, 2023.
Approval of this item will extend the contract term by six months for a new total contract period of January 1, 2019 through June 30, 2024, and allow for uninterrupted psychological services to County departments, while the Sheriff completes a new procurement process. Either party may terminate the agreement upon 60 days advanced written notice.
The contract with TCTI contains the following non-standard term that differs from the County’s standard contract:
1. The total contract period is five years and six months.
• The County’s standard contract term is five years, including any extensions.
• Potential Impact: Extending the contract term beyond five years may limit the County’s ability to preview new providers of counseling services and their capabilities; however, the Department believes the contract extension is in the best interest of the County to allow for adequate time to complete a competitive procurement for counseling services.
While this is a notable exception to the County’s standard contract language, the departments recommend approval of the amendment with TCTI to provide counseling services through June 30, 2024. This will ensure current counseling services to the County are not disrupted while a competitive procurement process is conducted to initiate a new contract for services. County Counsel has reviewed and provided input on the amendment.
PROCUREMENT
The Purchasing Department concurs that a non-competitive justification exists to extend the current contract to allow for uninterrupted service and to provide sufficient time to complete a new procurement process in compliance with County Policy 11-04.
