RECOMMENDATION(S)

Recommendation

1.                     Adopt Resolution declaring the Board of Supervisors’ intent to establish Community Facilities District 2025-1 (Speedway Commerce Center II) pursuant to the Mello-Roos Community Facilities Act of 1982 (California Government Code Section 53311 et seq.) and to levy a special tax within the district to fund, among other things, maintenance of public infrastructure, landscaping, flood protection, drainage, sewer systems, graffiti and debris removal, and maintenance and operation of County-owned properties.

2.                     Direct the Clerk of the Board of Supervisors to schedule a public hearing on April 29, 2025, at 10:00 a.m. regarding the proposed formation of Community Facilities District No. 2025-1 (Speedway Commerce Center II) and publish a Notice of Hearing in a newspaper of general circulation at least seven days before the hearing.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The first-year special tax for the district will cover all costs associated with the formation of Community Facilities District 2025-1 (Commerce Center II). 

 

BACKGROUND INFORMATION

Speedway Commerce Center II is a commercial and industrial development project approved by the Board of Supervisors (Board) October 25, 2022 (Item No. 102). In accordance with Development Agreement No. 22-1006, Article 11, Section A of the Development Agreement, the developer, Speedway SBC Development, LLC, has petitioned to establish a Community Facilities District (CFD) to ensure ongoing funding for maintenance, landscaping, street cleaning, road repair, traffic signals, street signs, sewer collection system, storm drains, and other operational needs associated with the development. Pursuant to California Government Code Section 53321), the Board must adopt a Resolution of Intention as the first step in the formation of the CFD.

 

The proposed CFD 2025-1 will levy a special tax on properties within its boundaries to provide the necessary funding. A public hearing will be scheduled to consider public testimony and protests regarding the formation of the CFD and the proposed levy of the special tax. The special tax proceeds of CFD No. 2025-1 may fund a variety of services under Section 53313 of the Mello-Roos Community Facilities Act of 1982. These services include maintaining streets, roadways, traffic and railroad signals, streetlights, signage, medians, sidewalks, driveways, open spaces, trails, trees, art displays, and other hardscapes. They also cover park and parkway maintenance, lighting, public landscaping, easements, and open spaces. Additionally, the funding supports the operation and upkeep of flood protection facilities, storm drainage systems, and sewer collection systems. Graffiti and debris removal from public improvements and maintenance of County-owned properties with a useful life of five or more years within CFD No. 2025-1 are also included.

 

The Department of Public Works - Special Districts (Department) oversees community facilities districts within the County's unincorporated areas. The Department has been working closely with the developer to ensure compliance with development requirements and to establish ongoing financing for the CFD. Upon the formation of the district and following the completion and acceptance of the work, the Department will take responsibility for oversight, management, and maintenance operations of the district.
