RECOMMENDATION(S)

Recommendation

Adopt Resolution for the Local Enforcement Agency Grant Program, as required by the California Department of Resources Recycling and Recovery, effective April 21, 2026 through April 20, 2031, authorizing the Director of the Department of Public Health to approve, execute and submit annual grant applications, non-substantive amendments and documents necessary to secure funding, on behalf of the County, subject to review by County Counsel.

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost).  The Resolution to the California Department of Resources Recycling and Recovery for the Local Enforcement Agency Grant Program is non-financial in nature.

 

BACKGROUND INFORMATION

The California Department of Resources Recycling and Recovery (CalRecycle) oversees a statewide program to enforce solid waste management regulations. CalRecycle designates a Local Enforcement Agency (LEA) to assist with these enforcement activities and administers the non-competitive LEA Grant Program, which exclusively supports the operations of solid waste facilities, permitting, and inspection programs.

 

The Department of Public Health (DPH), through its Division of Environmental Health Services (DEHS), is the designated LEA for San Bernardino County (County) and will use grant funding approved through the Resolution to support countywide inspections of landfills, transfer stations, composting facilities, chipping and grinding operations, and construction and demolition processing facilities. DEHS has successfully received LEA Grant Program funding since 2003.

 

CalRecycle issues funding for each grant cycle, subject to funding availability. The grant allocations are determined using a formula that calculates a base amount for each jurisdiction, with additional funds awarded based on population and the number of permitted, active solid waste facilities in each LEA jurisdiction.

 

The Director of DPH (Director) serves as the Signature Authority for the CalRecycle grant. Because DPH operates under a governing board, a resolution is required to authorize the Director to execute and submit grant-related documents.

Approval of this item adopts a five-year resolution identifying and authorizing the Director as the Signature Authority to sign grant-related documents necessary to implement and close-out the grant annually for the period of April 21, 2026 through April 20, 2031. This resolution will allow DPH to execute and submit the annual grant application, grant payment request, and a final report on behalf of the County, subject to review by County Counsel upon approval by the Board of this item.

 

DPH will return to the Board annually to request approval of the grant agreement. DPH anticipates receiving up to $60,000 annually through the CalRecycle grant.
