RECOMMENDATION(S)
Recommendation
1. Approve the use of the Amphitheater Improvement funds for the following projects at the Amphitheater in Glen Helen Regional Park:
a. Lighting Project in the amount of $100,000 to replace the current lighting fixtures with light-emitting diode LED lights.
b. Repair the Walk-In Freezer in Concession Stand A in the amount of $15,600.
2. Approve appropriation and revenue adjustment to fund the Capital Improvement Program projects and authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary budget adjustments, as detailed in the Financial Impact Section (Four votes required).

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). Regional Parks Department (Department) will fund the improvement project for the lighting ($100,000) and walk-in freezer in Concession Stand A ($15,600) with the use of the fund balance from the Amphitheatre Improvements Fund (2732) at Glen Helen Regional Park in the total amount of $115,600. The appropriation and revenue adjustments recommended are as follows:

BACKGROUND INFORMATION
On October 19, 1992 (Item No. 59), the Board of Supervisors approved Lease Agreement No. 92-1023 (Agreement) for the use and operation of the Glen Helen Amphitheater. The Agreement has been amended 11 times, with Amendment No. 7 specifically changing the contractor’s name to Live Nation. The Agreement provides for the establishment of an improvement fund. The improvement fund is maintained by the County as a separate interest-bearing fund. The purpose of the improvement fund is to pay for the modernization and improvements to the Glen Helen Amphitheater and its facilities. Each party must agree on the use of the improvement funds. Live Nation staff operating the Glen Helen Amphitheatre submitted requests for the Lighting and Walk-in Freezer in the Concession Stand A projects. After a review of the two requests, the Department agreed with the need for both projects.
The first project addresses the lighting at Glen Helen Amphitheater. The existing lighting around the amphitheater in Plaza A & B are no longer operable. Live Nation has performed routine maintenance of the lighting, but the lights are no longer functioning properly and are beyond repair. Replacement of parts is not an option as the current brand of lights is no longer manufactured. The project scope is to replace the most important areas in the amphitheater with current lighting fixtures and light-emitting diode “LED” lights. It would improve the guest experience and safety of all persons walking the property in the zones.
The second project is for the repair of the walk-in freezer in Concession Stand A at Glen Helen Amphitheatre. The amphitheater’s concession stand must have the ability to store food at a cold temperature. The walk-in freezer in Concession Stand A is broken and no longer working properly. This project would repair the broken walk-in freezer and improve the quality of infrastructure to store frozen food safely.
This recommended budget adjustment aligns with the County and Chief Executive Officer’s goals and objectives to operate in a fiscally-responsible and business-like manner, and provides for the safety, health, and social service needs of the County residents by improving safety on the property.
