Recommendation

Acting as the governing body of the San Bernardino County Flood Control District, approve Amendment No. 2 to Contract No. 4400028766 with Upland Rock, Inc., for material dumping services, increasing the total contract amount by $500,000, from $1,000,000, to an amount not to exceed $1,500,000 over the contract term and updating contract requirements with no change to the contract term of July 1, 2025 to June 30, 2030.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The San Bernardino County Flood Control District (District) is funded by property tax revenue, fee revenue, and local, state, and federal funding. Sufficient appropriation has been included in the District’s 2025-26 budget and will also be included in future recommended budgets. Amendment No. 2 will increase the not to exceed contract amount by $500,000, from $1,000,000 to $1,500,000.

 

BACKGROUND INFORMATION

The District maintains all flood control facilities (channels and basins) by removing debris and sediment. Due to the Line Fire burn scar, recent storms deposited significantly higher volumes of material into these facilities. To support clean-out efforts, Upland Rock, Inc. (Upland Rock), was selected as it is located two miles from the impacted area in the City of Highland and is willing to accept mixed sediment. Most dumping facilities do not accept mixed sediment due to the need for specialized processing, making Upland Rock the only feasible option for timely and locally convenient debris removal.

 

On July 23, 2025, the Purchasing Agent approved Contract No. 4400028766 (Contract) with Upland Rock for material dumping services, in the amount of $500,000, with a not to exceed amount of $100,000 per fiscal year. The contract covers dumping organic matter (dirt, sand, rock, etc.) at Upland Rock’s Highland facility, with rates fixed from July 1, 2025, through June 30, 2030.

 

The District originally anticipated annual disposal costs of approximately $100,000 per fiscal year. However, recent storms at the end of 2025 generated more debris than expected, requiring additional disposal capacity.

 

On February 12, 2026, Amendment No. 1 was approved by the Purchasing Agent to increase the Contract from a not to exceed amount of $100,000 per fiscal year to $200,000 per fiscal year and increasing the total contract amount from $500,000 to $1,000,000 with no change to the term.

 

Additional sediment remains to be disposed, and due to the continued storm impacts and the ongoing effects of the Line Fire burn scar, projected usage this year will exceed $200,000, which exceeds the Purchasing Agent’s authority. Staff anticipate that additional sediment disposal will be required for the next five years due to the Line Fire burn scar.

 

Under County Policy 11-04, competitive and non-competitive procurement of services where the annual aggregate cost, per scope of services, per vendor and Board-governed special district, such as the District, that exceeds $200,000 requires Board of Supervisors’ approval.

 

Amendment No. 2 also updates Contract to align with the District’s standard contract template and compliance requirements, including provisions related to the Iran Contracting Act, Levine Act, payment bond, prohibitions on contracting with entities that require certain internal confidentiality agreements or statements, use of biobased products, and service contract labor standards.

 

An increase in the total amount for Contract with Upland Rock will allow the District to continue using this vendor for material dumping services. Having these services in place before projects or emergencies occur reduces procurement delays, allowing debris and sediment to be cleared from flood control facilities without interruption. This ensures critical infrastructure remains operational, reduces flood risk, and supports the District’s goal of operating in a fiscally-responsible and business-like manner, as well as providing for the safety of District residents.

 

PROCUREMENT

A non-competitive justification form was submitted to the Purchasing Department on July 23, 2025, as the Upland Rock’s Highland facility is located within two miles of the most routinely inundated areas in the City of Highland. The District facilities in the City of Highland were affected after the Line Fire and routinely need sediment excavation, and it’s projected to need continued sediment clean-up for the next five years due to the burn scar. Upland Rock is the only local vendor capable of accepting mixed material dumping. No other facility has the processing capability of accepting mixed sediment. The Purchasing Agent supports this non-competitive procurement.
