Recommendation
1. Approve Amendment No. 1 to the Memorandum of Understanding No. 25-205 with Southern California Association of Governments, updating Section 6 to extend the agreement term by 185 calendar days, for a full term of May 15, 2025 through December 31, 2026, with no change to the not-to-exceed amount of $6,508,000.
2. Authorize the Director or Assistant Director of the Department of Public Works to Execute Amendment No. 1 to the Memorandum of Understanding with Southern California Association of Governments, subject to review by County Counsel.
3. Direct the Director of the Department of Public Works to transmit executed Amendment No. 1. to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The grant from Southern California Association of Governments (SCAG), in the amount not-to-exceed $6,508,000, provides funding for the Bloomington Sewer Expansion Project (Project). The grant has no local match component. This grant will be used to fund the eligible costs of the Project. The grant covers the cost of the design and subsequent construction of the Project.
Sufficient appropriation for the Project was included in the County Service Area (CSA) 70 BL - Bloomington (District) and the Department of Public Works - Transportation’s (Department) 2025-26 respective budgets and will be included in future recommended budgets as needed.
BACKGROUND INFORMATION
The Project is located in the unincorporated Bloomington area surrounded by the cities of Rialto and Fontana, and includes installing a sewer main on Marygold Avenue, Locust Avenue and Linden Avenue, enabling property owners to transition from septic to sewer. It is estimated that approximately 150 parcels would benefit from this sewer system.
On October 24, 2023 (Item No. 55), the Board of Supervisors (Board) authorized the Department to submit a Regional Utilities Supporting Housing grant application to SCAG for the Project.
On April 8, 2025 (Item No. 62), the Board approved Memorandum of Understanding No 25-205 to provide funding for the Project, in the amount of $6,508,000, for the contract term of May 15, 2025 through June 30, 2026.
Approval of Amendment No. 1 (Amendment) to the Memorandum of Understanding with SCAG amends the invoice submittal term from 30 days to 90 days, which provides a mechanism for funding, on a cost reimbursement basis, for the Project that the County can meet. The Amendment will also extend the MOU term by 185 calendar days, for the full term of May 15,, 2025 to December 31, 2026. It is SCAG’s practice for grantees, such as the County, to approve and sign grant agreements before SCAG’s final execution.
The Department is requesting the Board to designate the Director and Assistant Director of the Department as the position with the authority to execute this Amendment. The request is due to SCAG only accepting DocuSign.
