Recommendation
1. Acting as the governing body of the San Bernardino County Fire Protection District, approve Amendment No. 1 to Agreement No. 20-314 with the San Bernardino County, Department of Public Works, Solid Waste Management Division, in which the San Bernardino County Fire Protection District shall receive compensation from San Bernardino County in the amount of $274,000 annually, for a total amount of $1,370,000, plus the portion of the Solid Waste Management Division’s disposal site fee attributable to the per vehicle charge established in the San Bernardino County Fire Protection District’s fee ordinance, for the Solid Waste Management Division’s participation in the Household Hazardous Waste Collection Program, extending the term for an additional five years, for a total contract period of July 1, 2020, through June 30, 2030, with all other contract terms remaining in effect.

FINANCIAL IMPACT
Approval of the recommended actions will not result in the use of Discretionary General Funding (Net County Cost) as Solid Waste Management Division’s (SWMD) costs are financed by fee revenue. SWMD will compensate San Bernardino County Fire Protection District’s (SBCFPD) Household Hazardous Waste (HHW) Division $274,000 annually for a period of five years plus the portion of the disposal site fee attributable to the per vehicle charge (currently $0.80 per vehicle) established in the SBCFPD fee ordinance for participation in the HHW Collection Program. This vehicle charge corresponds to each vehicle that enters a County landfill, to recover costs for SWMD’s continued participation in the HHW Collection Program. SWMD will recover the costs associated with Agreement No. 20-314 (Agreement) through established fees charged to the public and other agencies for utilization of the County’s Waste Disposal System. Sufficient appropriation and revenue for this Agreement is included in both SBCFPD’s and SWMD’s 2025-26 budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
On May 19, 2020 (Item No. 102), the Board of Supervisors and the Board of Directors approved the Agreement for SWMD’s participation in SBCFPD’s HHW Collection Program. The Agreement was in the amount of $274,000 annually, for a total amount of $1,370,000, plus the portion of SWMD’s disposal site fee attributable to the per vehicle charge established in SBCFPD’s fee ordinance, for the period of July 1, 2020, through June 30, 2025. This Agreement formalized the terms, conditions, and obligations of SWMD and SBCFPD as they relate to SBCFPD’s provision of the HHW Collection Program services to the County.
SBCFPD’s HHW Collection Program was implemented by the County in 1984 and provides for the collection and management of HHW, including used motor oil and oil filters, electronic waste (such as cathode ray tubes and other electronics), universal waste (such as fluorescent tubes and household batteries), pesticides, herbicides, and pharmaceuticals (excluding controlled substances). Under the direction and administration of SBCFPD, this regional program includes the unincorporated area of the County and 24 cities/towns, providing a cost-effective system of collection, control, and disposal of HHW and allows for the diversion of HHW from SWMD’s landfill system.
Any resident or business who drops off waste at a County landfill is charged a standard gate fee based on the weight or volume of the material. This fee is collected by the SWMD. SWMD then transfers a portion of the gate fee to the HHW Program, $0.80 per vehicle. This transfer is made because HHW helps divert household hazardous waste from entering the landfills, which supports SWMD’s diversion and environmental goals.
Approval of Amendment No. 1 to the Agreement extends the term for an additional five years, continuing through June 30, 2030, and updates the mailing address information for SBCFPD due to the relocation of its headquarters. All other terms of the Agreement remain the same.
