Recommendation
1. Acting as the governing body of San Bernardino County:
a. Approve an allocation of $253,876 from the 2023-24 Fifth District’s Board of Supervisors Discretionary Fund - District Specific Priorities Program budget to Bloomington Recreation and Park District for the Ayala Park Splash Pad Project.
b. Approve contract with Bloomington Recreation and Park District to provide funding for the Ayala Park Splash Pad Project in the amount of $1,448,400, including $1,194,524 in American Rescue Plan Act funding and $253,876 from the District Specific Priorities Program budget, for the contract term of December 5, 2023 through December 31, 2026.
c. Authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary budget adjustments, as detailed in the Financial Impact section, to provide funding for the Ayala Park Splash Pad Project (Four votes required).
2. Acting as the governing body of Bloomington Recreation and Park District:
a. Approve the Capital Improvement Program - Ayala Park Splash Pad Project in the amount of $1,448,400.
b. Approve contract with San Bernardino County to receive funding for the Ayala Park Splash Pad Project in the amount of $1,448,400 for the contract term of December 5, 2023 through December 31, 2026.
c. Approve the use up to $1,194,524 of American Rescue Plan Act funding for eligible costs of the Ayala Park Splash Pad Project.
d. Authorize the Auditor-Controller/Treasurer/Tax Collector to post budget adjustments in the amount of $1,448,400, as detailed in the Financial Impact section, to the Bloomington Recreation and Park District’s 2023-24 Capital Improvement Program for the Ayala Park Splash Pad Project (Four votes required).

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). On September 21, 2021 (Item No. 18) and November 16, 2021 (Item No. 33), the Board of Supervisors (Board) approved an allocation of $4 million and $7 million, respectively, to the Board Discretionary Fund - District Specific Priorities Program (Priorities Program) for each of the five supervisorial districts to fund projects that meet a public purpose, and provide services to citizens that promote health, safety, economic well-being, and other public services that enhance quality of life and meet the needs of the county residents. On an annual basis, unspent appropriation for discretionary funding is carried over into the subsequent year’s budget.
This item recommends allocating $253,876 from the Fifth District’s Priorities Program budget for the Ayala Park Splash Pad Project (Project).
This item also seeks authorization for the use of $1,194,524 from County’s American Rescue Plan Act (ARPA), Local Fiscal Recovery Fund (Recovery Fund) to fund eligible costs for the Project. At the recommendation of the Fifth District Board Office, the Project is approved to proceed and be funded partially by the Fifth District’s ARPA Recovery Fund. Project costs include design of the plans and specifications and subsequent construction.

Sufficient appropriation for the Project will be included in the Bloomington Recreation and Park District, Special Districts ARPA CIP Fund, and ARPA Recovery Fund future recommended budgets as needed.
BACKGROUND INFORMATION
Priorities Program projects help promote the vision of a complete County by recognizing the unique traits of each Supervisorial District and, thereby, allow individual Board Districts to work with community partners through County services and contractual agreements to identify programs, projects, and initiatives that support the vision, meet a public purpose and provide services to residents that promote health, safety, economic well-being, education, recreation, and other public services that enhance quality of life, and meet the needs of the county’s residents. Projects under the Priorities Program are based on District Supervisor discretion and are presented by the Chief Executive Officer (CEO) for Board approval.
On March 11, 2021, ARPA was signed into law that established the $350 billion Coronavirus State and Local Fiscal Recovery Fund to distribute resources to state and local governments throughout the nation. The Project was identified by the County’s ARPA team as being eligible for ARPA funding and is consistent with the San Bernardino County Coronavirus Local Fiscal Recovery Fund Spending Plan that was approved by the Board on June 8, 2021 (Item No. 121).
Ayala Park (Park) is located within the Bloomington Recreation and Park District (District), which encompasses the community of Bloomington. The Department of Public Works - Special Districts, through its Operations Division, directly manages, operates, and maintains the District, including the Park.
The Project proposes the construction of a 40-foot diameter splash pad. The addition of the splash pad will provide a fun, low-impact, and social environment for families to enjoy within the Bloomington area.
This item seeks approval of a contract between the County and the District in the amount of $1,448,400 to fund the Project and serves the public purpose of providing for the public benefit, welfare, health, recreational and social needs of residents.
Board discretionary funding allocations under the Priorities Program are non-competitive and must be for projects or services of $50,000 or more. Contracts shall be paid on a lump-sum basis or under other terms as approved by the Board.
PROCUREMENT
The District will return to the Board for approval of the Project’s plans and specifications, authorization to advertise for competitive bids, and ultimately award of the construction contract.
